The Village Board of Crab Orchard unanimously passed an ordinance prohibiting certain types of animals within the village’s residential area on December 8. There were no opposing comments among the residents in attendance at the meeting.
According to Margie Laflin, Crab Orchard Village Clerk, the passage of this new ordinance on animal regulations just clarifies the regulations for the types of animals that would and would not be allowed in Crab Orchard’s residential area. Laflin indicated that the village had previous ordinances relating to animal regulations, but they became null and void because they weren’t properly publicized.
Andrew Carouthers of Beatrice, village attorney, created this ordinance concerning animal regulations based upon diligent research of other state and village regulations relating to animals in residential areas.
According to Laflin, the regulations in this new ordinance are clear and will be enforced if necessary.
Prohibited animals include: dogs that fall within the definition of “pit bull”, including American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, and American Bully; beef or dairy cattle; miniature cattle; horses and miniature horses; donkeys and miniature donkeys; swine; pot-bellied pigs; alpacas; llamas; camels, kangaroos; or any other large animal not indigenous to the State of Nebraska; as well as wild animals such as mountain lions, bighorn sheep, mule deer, whitetail deer, antelope, coyote, badger, beaver, bobcat, lynx, grey and red fox, mink, muskrat, opossum, raccoon, river otter, weasel, squirrel, cottontail rabbits, partridge, pheasant, quail, swans, crows, wild ducks, wild geese, grouse, prairie chickens, and wild turkeys.
Any such animals residing in the village at the time the ordinance was passed are grandfathered in, but this applies to the specific animals. Once those specific animals are removed from the corporate limits for more than a month, they cannot be returned to the city limits and any of the specific animals that die may not be replaced.
A statement of intent within the ordinance clarifies the purpose of the Village Board: “It is the express intent of the Village Board of Trustees that the grandfathered animals described above will eventually be completely absent from the corporate limits either by the passage of time or death.”
