NOTICE OF PERMIT
ISSUANCE
The Nebraska Department of Environmental Quality (NDEQ) proposes to reissue with change the National Pollutant Discharge Elimination System (NPDES) permit for the City of Nemaha WWTF  (NPDES# NE0121304; SIC 4952).  The POTW which receives and treats domestic wastewater is a 2-cell constructed wetland treatment system, which has been planted with vegetation such as reeds to reduce pollutant concentrations.  A 2-cell lagoon system precedes the wetland treatment system, which received sanitary wastes from the village via a lift station.  An effluent flow pump discharges the treated wastewater from the wetland system through Outfall 001 to the Little Nemaha River, segment NE3-10000 of the Nemaha River Basin.  The permit will be issued for a period of up to five years and would restrict pollutant discharges to comply with the requirements of Department regulations.  The draft permit, fact sheet and other public information are available for review at NDEQ’s Lincoln Office (address below) between 8:00 a.m. and 5:00 p.m. weekdays, excluding holidays.  To request copies of the draft permit and other information, call 402/471-3557 (TDD operator 711).  Alternate format materials are available with advance request.  Written comments, objection and/or hearing requests concerning permit issuance may be submitted to Alan Aanerud, NPDES/NPP Permits Unit, Nebraska Department of Environmental Quality, 1200 N St., Suite 400, the Atrium, PO Box 98922, Lincoln, NE 68509-8922 before the comment period ending date of December 18, 2011.  A determination to hold a hearing will be based upon factual environmental or regulatory consideration.

november 9, 2011
County Board of Commissioners of the County of Nemaha, State of Nebraska met on November 9, 2011, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on November 3, 2011. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Hutton called the meeting to order at 8:05 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley.
Chairman Hutton noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.

Mary Kruger was present to discuss lodging county committee’s past, present and future funding of the committee.  She also presented a detailed report of expenditures of the county visitors and county improvement
Steve Schutz, representative of Colonial Life presented information on the pre-tax benefits his company could provide to Nemaha County employees.  Board approved allowing him to contact the employees to explain Colonial Life’s pre-tax benefits.   
Brent Lottman visited with the Board regarding the disposition and replacement of the totaled cruiser.  Motion by Bohling, seconded by Wittmann to authorize Sheriff Brent Lottman to be the contact person with NIRMA on the settlement of the cruiser that was totaled in a pursuit.  Roll call vote:  Wittmann, aye; Bohling, aye; Hutton, aye.

MINUTES OF A REGULAR MEETING OF THE MAYOR AND CITY COUNCIL OF PERU, NEBRASKA ON
OCTOBER 12, 2011 AT 7:00 P.M.
Present were: Mayor Lesley Ryan and Council Members: Jay Moran, Judie Douglas, Ken Hastings and Joe Whisler.  Dave Hunter with the Auburn Board of Public Works and Kristie Wemhoff were also present.  FEMA representatives arrived at 7:15 p.m.
Mayor Ryan called the meeting to order and informed the public of the location of the posting of the Nebraska Open Meetings Act.
The Council reviewed the minutes from the September 12, 2011 Council Meeting, September 12, 2011 Budget Hearing and the September 12, 2011 Final Tax Request Hearing.  All minutes were approved.
The City Clerk reported the July 2011 sales tax deposit was $2,382.38.  Other correspondence was received.
The monthly claims were reviewed.   After brief discussion, Council Member Whisler made motion to accept the claims as presented with the exception of Nebraska Machinery and PeopleService.  Motion was seconded by Council Member Moran.  Vote indicated:  “AYE” All.  Motion: Carried.  September claims paid are as follows:

No Mayor’s Report was made available by the maintenance workers and Mayor Ryan asked the Clerk to write a work order to request this for future meetings.
FEMA was not present to make planned presentation.
Dave Hunter with the Auburn Board of Public Works was present to discuss water plant operations.
FEMA arrived at 7:15 p.m.  Council Member Moran made motion to suspend Agenda Item #2 with Dave Hunter and move to Agenda Item #1 to allow for the FEMA presentation.  Motion was seconded by Council Member Hastings.  Vote indicated:  “AYE” All.  Motion: Carried.
Sean Waites and Larry Crambert with FEMA were present to share information on how they work as a liaison between communities and FEMA
The Council proceeded with Agenda Item #2.  Dave Hunter stated some other things that need to be addressed at the water plant include a pump that is not working, a well that is not working and said the Clerk told him an electrician is supposed to be here next week to check on the well pump.  Lengthy discussion followed.
Regarding the City of Peru/Auburn Board of Public Works Water Operator Agreement, Dave Hunter said we need to change the section on page two regarding consideration to include overtime pay at time and one-half.   It was also discussed to have the current agreement cover October 1, 2011 to January 1, 2012 at a regular rate of $30.00 per hour and overtime rate at time and one-half.  After January 1, 1012, the regular rate would be $35.00 per hour.  After discussion, Council Member Whisler made motion to approve the Auburn Board of Public Works Water Operator Agreement as discussed.  Motion was seconded by Council Member Hastings.  Vote indicated:  “AYE” All.  Motion: Carried.
Following brief discussion, Council Member Moran made motion to approve the recommendation of acceptance for the 5th Street improvement project.  Motion was seconded by Council Member Whisler.  Vote indicated:  “AYE” All.  Motion: Carried.
Regarding the selection of the repayment term for the 5th Street Improvement project, the City Clerk explained that if the City went with a 10 year bond, the annual payment would be $13,154.00 and with a 15 year bond, the annual payment would be $9,878.00.  The Clerk explained that although the payment would be much less, the difference in interest paid would be approximately $17,000.00.   Council Member Moran made motion to select a ten year bond repayment schedule.  Motion was seconded by Council Member Hastings.  Vote indicated:  “AYE” All.  Motion: Carried.
Council Member Whisler made motion to approve the interlocal cooperation agreement between the Peru RFD #3 and the City of Peru.  Motion was seconded by Council Member Moran.  Vote indicated:  “AYE” All.  Motion: Carried.
Regarding the need for a Class IV water operator, the Clerk provided written information to the Council. It states that the City has been advised, by Fred Baumert with the Nebraska Department of Health & Human Services, to have someone that is full-time and lives in Peru, to obtain their class IV water operator license to oversee the maintenance workers when exercising valves and hydrants.  Mr. Baumert has recommended that either Jay Moran or Cindy Moran become licensed.  After lengthy discussion, Council Member Whisler made motion to approve that Jay and Cindy Moran obtain their Class IV Water Operator license.  Motion was seconded by Council Member Hastings.  Vote indicated: “AYE” Douglas, Hastings and Whisler.  “ABSTAIN” Moran.  Motion:  Carried.
