City Council Proceedings
May 23, 2011
The Mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on May 23, 2011, at 7:00 o’clock P.M., in Regular Meeting, open to the general public.
The meeting was called to order by Mayor Scott Kudrna.  Upon roll call, the following members of the City Council were present:  Billings, Bishop, Clark, Critser, Erickson, and Holtzman. Absent:  No one.  
Mayor Kudrna announced “I am required by law to inform the public that a copy of the Open Meetings Act is posted on the North wall of these Chambers by the entrance door”.  
With Council Member Erickson abstaining from the vote and all other Council Members voting in favor, Council approved the April 25, 2011, meeting’s minutes as written.
The City Council approved the financial report.
Claims from Auburn Plumbing, Heating & AC Inc. for invoices totaling $2,664.64 were presented before the Council for approval.  A Contractual Interest Statement has been filed by Council Member Mitch Bishop stating that he has an interest in contracts/business involving Auburn Plumbing, Heating & AC Inc.   His interest is that he is President of Auburn Plumbing, Heating & AC Inc.  With Council Member Bishop abstaining from the vote and all other Council Members (Critser, Erickson, Holtzman, Billings, Clark) voting in favor, the claims from Auburn Plumbing, Heating & AC Inc. were approved.

Jeff Rowell to the Auburn Volunteer Fire Department.

The request by American Legion Post 23 for a Special Designated Liquor License on July 15, 2011 for a beer garden at 909 I Street was approved.
The request by American Legion Post for a Special Designated Liquor License on July 16, 2011 for a beer garden and concert event at the Nemaha County Fair Ball Field was presented, public comment was heard and discussion was held. A motion to table action failed after Mayor Kudrna broke a tie vote by voting no.  The vote to table was as follows:  Voting Yea (Bishop, Critser, Holtzman) and Voting Nay (Clark, Erickson, Billings and Mayor Kudrna).  With four Council Members (Clark, Critser, Billings, and Bishop) voting in favor and two Council Members (Erickson and Holtzman) voting in opposition, the request by American Legion Post for a Special Designated Liquor License on July 16, 2011 for a beer garden and concert event at the Nemaha County Fair Ball Field was then approved.
The request by Rachelle Emshoff/Hickory Road BBQ for a Special Designated Liquor License on June 11, 2011 for a beer garden/dance/fundraiser event to be held behind the restaurant and into the city hall parking lot area for the fire department’s 100th anniversary was approved.  The City Council also approved the request on the alternate band location at the Fire Hall.   
The request by Rachelle Emshoff/Hickory Road BBQ for a Special Designated Liquor License on July 8, 2011 for a beer garden and dance to be held behind the restaurant and into the city hall parking lot area was approved.
The City Council authorized the chief elected official to execute all necessary documents for 10-DTR-105 Phase 2 Downtown Revitalization Grant Program Contract between NeDED & City by the passage and adoption of Resolution No. 9-11.
The City Council authorized the chief elected Official to execute the General Administration Contract between SENDD & City of Auburn for 10-DTR-105 CDBG – Downtown Revitalization Phase II by the passage and adoption of Resolution No. 10-11.
CDBG #09-HO-6047 “Citywide” Owner-Occupied Housing Rehabilitation Drawdown #14 and the related claims were approved.
NSP Grant #095-ND-38 Demolition project Drawdown #10 Final and the related claims were approved.
The passage and adoption of Resolution No. 11-11 approved the report of unpaid sewer accounts and authorized that said items be certified to the Nemaha County Clerk and filed as liens.
The passage and adoption of Resolution No. 12-11 approved the report of unpaid water accounts and authorized that said items be certified to the Nemaha County Clerk and filed as liens.  
With five Council Members (Billings, Bishop, Clark, Critser, and Holtzman) voting in favor and one Council Member (Erickson) voting in opposition, the bid of Meyer Earp for a 2011 Chevrolet Caprice was approved to be paid from the Police Department budget with the amount not to exceed $31,395.
The passage and adoption of Resolution No. 13-11 allows the City to back a $25,000 CRA loan needed to start the west Auburn project.
The City Council tabled action on the proposed ordinances to update the City’s Code of Ordinances.
No action was taken on the proposed ordinance regarding raising Black Hills Energy’s franchise fee to the City of Auburn to the equivalent of 3% of gross sales or the proposed ordinance regarding raising the Board of Public Works revenue payment to 5% gross electric sales or the equivalent thereof.
Reports were given by the following department heads:  street department, library, fire department, police department and City Treasurer.  Written financial reports were given on the
sales tax receipts, investments, operating expenditures in April 2011 compared to April 2010, and a report of services provided by the Board of Public Works.
The following committees provided reports:  Street, Keep Auburn Beautiful, Budget/Finance, Economic Development, Safety Committee, Building Committee, Legislative and Garbage Collection.  A written financial report was provided by the Auburn Community Redevelopment Authority.
There being no further business to come before the Mayor and Council, the City Council adjourned.

City Council Proceedings
June 14, 2011
The mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on June 14, 2011 at 6:00 o’clock P.M. in Emergency Meeting, open to the general public.
The meeting was called to order by Mayor Scott Kudrna.  Upon roll call, the following members of the City Council were present:  Billings, Bishop, Clark, Critser.  Absent:  Erickson, Holtzman.
Mayor Kudrna announced that the Open Meetings Act is posted on the North wall of the Chambers by the entrance door.
Mayor Kudrna announced the purpose of the emergency meeting was for the Council to consider a Resolution acknowledging that the city accepts the duties set out in Nebraska Revised Statute §39-1359(2), for the temporary use of the State Highways, US Hwy 75 and US Hwy 136, for the holding of a Special Event Designation with the Nebraska Department of Roads for the parade held in conjunction with the Nemaha County Fair on July 15, 2011 Neb.Rev.Stat. §39-1359 requires a formal official governing body acknowledgement and 30 days advance notice to the NDOR for temporary use of the state highway system for a special event and this emergency meeting was called to comply with statutory notice requirements.
Kris Baker, Police Chief, explained the revised requirements for requesting temporary use of the state highway system for special events, such as parades, and the need for a 30-day notice of said event to the Nebraska Department of Roads.
Angelo Ligouri, City Attorney, explained the city code section regarding emergency meetings, and why the need for an emergency meeting was in order to meet the requirements of LB 589 which recently modified Neb. Rev. Stat. §39-1359.
Following discussion, Resolution No. 14-11 accepting the duties set out in Nebraska Revised Statute §39-1359(2) for the temporary use of the State Highway, US Hwy 75 and Hwy 136 for the holding of a Special Event Designated permit for the Nemaha County Fair parade was adopted.
There being no further business to come before the Mayor and Council, the City Council adjourned.
