In the Matter of Application MT-39 for a Municipal and Rural Domestic    NOTICE Ground Water Transfers Permit.
Notice is hereby given that the City of Auburn (Applicant) has filed an application for a permit under the provisions of the Municipal and Rural Domestic Ground Water Transfers Permit Act, Sections 46-638 through 46-650 RSS.  Application MT-39 requests a permit to withdraw 180,250,000 gallons (approximately 553 acre-feet) per year from Auburn’s 13 existing production wells, identified in the Department’s records as G-063101A, G‑063102A, G-063102B, and G-063102C, located in Section 15; G-063101D, located in Section 16; G-067034F, located in Section 23; G-067034A, G‑067034B, G-067034C, G-067034D, G-067034E, and G-072068, located in Section 24; and G-126226, located in Section 25, all in Township 5 North, Range 14 East of the 6th P.M. in Nemaha County, Nebraska.  The water will be transported for municipal use in the service area of the City of Auburn, Nebraska.  The Application may be viewed at the Department’s office in Lincoln.  Contact Tracy Zayac at 402-471-2363 to arrange a time to see the application.  
The criteria that the Department must consider in determining whether to grant or deny a permit under the Municipal and Rural Domestic Ground Water Transfers Permit Act are specified in Section 46-613.01, subdivisions (1) through (7) RSS, and listed below:
(1)  The nature of the proposed use and whether it is a beneficial use of ground water;
(2)  The availability to the applicant of alternative sources of surface or ground water;
(3)  Any negative effect of the proposed withdrawal on ground water supplies needed to meet present or reasonable future demands for water in the area of the proposed withdrawal, to comply with any interstate compact or decree, or to fulfill the provisions of any other formal state contract or agreement;
(4)  Any negative effect of the proposed withdrawal on surface water supplies needed to meet present or reasonable future demands within the state, to comply with any interstate compact or decree, or to fulfill the provisions of any other formal state contract or agreement;
(5)  Any adverse environmental effect of the proposed withdrawal or transportation of ground water;
(6)  The cumulative effect of the proposed withdrawal and transfer relative to the matters listed in subdivisions (3) through (6) of this section when considered in conjunction with all other transfers subject to this section; and
(7)  Any other factors consistent with the purposes of this section that the director deems relevant to protect the health, safety, and welfare of the state and its citizens.
Any person with a legal or equitable interest in the subject matter may object to the Application and request a hearing by filing a formal written objection and request for hearing, accompanied by a $10 filing fee, with  the Department of Natural Resources, P.O. Box 94676, Lincoln, NE 68509-4676, Attention: Tracy Zayac, by May 25, 2011.  Objections may be filed by the interested person or by an attorney on behalf of the interested person.  The objection must include the following:
1. Your name, address, and contact information, and the same information for the attorney;
2. Identification number of the Application to which you are objecting;
3. A description of your qualifying legal or equitable interest in the subject matter; and
4. A specifically stated basis for your objection, referring to one or more of the criteria listed above.
If you also want a hearing, you must state that you want a hearing.  If the objection does not contain a request for a hearing, then none will be held, and the objection will be placed in the Application file and considered by the Department when making the decision whether or not to issue the permit.

NOTICE OF CREATION OF STREET IMPROVEMENT
DISTRICT NO. 2011-01
Notice is hereby given that at a meeting of the Mayor and City Council of the City of Peru, Nemaha County, Nebraska, held May 9, 2011, at 7:00 p.m.. there was passed and approved Ordinance No. 2011-01 creating and establishing Street Improvement District No. 2011-01.
The outer boundaries of said Street Improvement District No. 2011-01 are as follows:
The street to be improved and all appurtenant property
And within which district the following streets shall be improved:
5th Street from Main Street to Walnut Street
Improvements in Street Improvement District No. 2011-01 shall consist of placing asphaltic concrete surface course on 5th Street from Main Street to Walnut Street and construction of appurtenant storm sewer inlets(s) and appurtenant storm sewer pipe adjacent to 5th Street between Sycamore Street and Walnut Street.
Said improvements are to be made in accordance with plans and specifications prepared by the City’s Engineers and approved by the Mayor and City Council.  The cost of said improvements shall be assessed against the property within Street Improvement District No. 2011-01 which is specially benefited thereby, in proportion to such benefits.
If the owners of record title representing more than fifty percent (50%) of the front footage of the property directly abutting the street to be improved within said Street Improvement District No. 2011-01 shall file with the City Clerk written objections to the creation of said District and the construction of the improvements therein, within twenty (20) days after the first publication of this notice, said work shall not be done in said District and the Ordinance creating the District shall be repealed.  If sufficient objections are not filed against said District in the time and manner aforesaid, the Mayor and City Council shall forthwith proceed to construct said improvements in the District and shall contract therefor.  A hearing will be held on June 13, 2011 at 6:45 p.m. at the City Hall relative to any written objection filed against the said proposed Street Improvement District.

MINUTES OF A REGULAR MEETING OF THE MAYOR AND CITY COUNCIL OF PERU, NEBRASKA ON
MARCH  14 , 2011 AT 7:00 P.M.
Present were: Mayor Lesley Ryan and Council Members: Jay Moran, Judie Douglas, Joe Whisler and Ken Hastings.  Upon roll call by the City Clerk, a quorum was declared.   Also present were Cody Wickham with D.A. Davidson & Co. and Jake Dugger with Utility Service Co.  Other members of the public were also present.
Mayor Ryan called the meeting to order and informed the public of the location of the posting of the Nebraska Open Meetings Act.
The Council reviewed the minutes from the March 14, 2011 Council Meeting.  Council Member Whisler made motion to accept the minutes as written.  Council Member Hastings seconded the motion for acceptance.  Vote indicated: “AYE” All.  Motion: Carried.
The City Clerk reported the January 2011 sales tax deposit was $3,690.82.  Correspondence was received from the U.S. Census Bureau, Nebraska Municipal Power Pool, NE Department of Roads and monthly water plant maintenance expenditures were received from PeopleService.
The monthly claims were reviewed.   Council Member Whisler made motion to accept the   claims as presented.  Motion was seconded by Council Member Douglas for acceptance.  Vote indicated:  “AYE” Douglas, Whisler and Hastings.  “ABSTAIN” Moran.   Motion: Carried.  March claims paid are as follows:

The March water report is available at City Hall for public inspection.
Mayor Ryan presented her Mayor’s report for March.  The city maintenance workers performed the following work during March: Maintained the white goods site and compost area, picked up trash, cleared debris from ditches and corners, did some initial alley work and street maintenance, installed water meters and did some equipment maintenance.  Mayor Ryan mentioned she believed we enjoyed having the Peruvians here.
Cody Wickham with D.A. Davidson & Co. presented information to the Council regarding the possibility of bonding the north 5th Street overlay project and storm sewer work.  After discussion, Council Member Hastings made a motion to bond the north 5th Street overlay and storm sewer project.  Motion was seconded by Council Member Moran.  Vote indicated: “AYE” All.  Motion: Carried.
Jake Dugger with Utility Service Company was present to explain to the Council the benefits of the full service maintenance program which the city has been a part of for four years.  Mr. Dugger explained that when we started this program, not only did they inspect, repair and paint the tower four years ago, but they have taken over total responsibility for the tower.  He explained that not only do they continue to inspect and make repairs to the tower, but in 6 years, the tower will again be painted and the interior will also be painted.  Mayor Ryan and the Council thanked Mr. Dugger.
Council Member Whisler made motion to ratify the phone poll conducted on 3/22/11 to allow the Civil War Re-enactment at the Trailhead on 4/15/11.  Motion was seconded by Council Member Hastings.  Vote indicated:  “AYE” All.  Motion:  Carried.
Council Member Whisler made motion to ratify the phone poll conducted on 3/29/11 to allow 5th Street to be closed on 4/2/11 from noon to 6:30 p.m. for a film shoot from the VFW to Cotty’s.  Motion was seconded by Council Member Moran.  Vote indicated:  “AYE” All.  Motion: Carried.
Mayor Ryan explained that regarding the PAL’s Easter Egg Hunt donation request, the City donated $200.00 last year.  Council Member Whisler made motion to donate $200.00 to the PAL’s Easter Egg Hunt.  Motion was seconded by Council Member Douglas.  Vote indicated:  “AYE” All.  Motion: Carried.
Ken Hastings representing the Chamber, asked permission from the Council to close California Street from 3rd to 5th on May 21st from 10:00 a.m. to 5:00 p.m. for a Street Derby.  Hastings asked if he was required to contact the homeowners prior to the street being closed.  Council Member Moran asked how these people would get out and Hastings said that is what he is concerned about.  Mayor Ryan said the affected individuals could park at the City Shop during this time.  Mayor Ryan suggested the Council approve this contingent upon Ken notifying the home owners affected by this closing.  Moran asked if Ken was going to provide the barricades to close the street.  Ken said he has that lined out.  Council Member Moran made motion to allow California St. to be closed on May 21st from 10:00 a.m. to 5:00 p.m. for a Street Derby, contingent upon Ken Hastings getting approval from affected homeowners.  Motion was seconded by Council Member Whisler.  Vote indicated:  “AYE”  Moran, Douglas, Whisler.  “ABSTAIN” Hastings.  Motion: Carried.
Ken Hastings and Cheryl Cotton approached the Council requesting permission to conduct a beer garden and close a portion of 5th Street for Old Man River Days.  After brief discussion, Council Member Moran made motion to allow Cotty’s and Shooter’s to conduct a beer garden and close 5th Street in front of their business on June 3rd from 5:00 p.m. to 1:00 a.m. and June 4th from 9:00 a.m. to 1:00 a.m. for Old Man River Days.  Motion was seconded by Council Member Whisler.  Vote indicated:  “AYE” Moran, Douglas, Whisler.  “ABSTAIN” Hastings.  Motion: Carried.
Kristie Wemhoff, representing the Peru VFW Club, submitted a written request to conduct a beer garden at the VFW Club on Saturday, May 21st from 10:00 a.m. to 1:00 a.m. for the Chamber Street Derby and for a VFW member’s coming home reception.  Council Member Whisler made motion to allow a beer garden be conducted at the VFW Club on May 21st from 10:00 a.m. to 1:00 a.m.  Motion was seconded by Council Member Hastings.  Vote indicated:  “AYE” All.  Motion: Carried.
Kevin Turner was present and approached the Council requesting permission to move in a mobile home at his 916 7th Street property.  After lengthy discussion, Mayor Ryan said the Planning and Zoning Commission needs to meet and if they allow it, they will then make recommendation to the Council and we would then adopt an ordinance to rezone this particular lot.  Mayor Ryan said the Council is not over riding Mr. Hogue’s decision to deny this building permit, just requesting Mr. Turner apply for rezoning of his property.
Regarding the new Agenda Item, “Public Voice”, Mayor Ryan explained members of the public are given this opportunity to approach the Council about any concerns they may have.  No discussion or action can be taken during this time.  There was no public voice.
