OCTOBER 27, 2010
County Board of Commissioners of the County of Nemaha, State of Nebraska met on October 27, 2010, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on October 21, 2010. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Lovelace called the meeting to order at 9:10 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Monty Lovelace, Commissioner District 3 Randy Rohrs and County Clerk Joyce Oakley.

Brent Lottman Nemaha County Sheriff presented an Antenna Site Lease Agreement by and between Haug Communications and Nemaha County, Nebraska for approval by the Board of Commissioners. The lease effective date is November 1, 2010, monthly fee of $150.00 + $15.00 for utilities, term of lease - 5 years, for a single antenna mast at 150’ or below, and a Motorola Quantar 450-460 Mhz transmitter at the Johnson NE Tower Site.  Motion by Rohrs, seconded by Lovelace approve the Antenna Site Lease Agreement with Haug Communications.  Roll call vote:  Lovelace, aye; Hutton, aye; Rohrs, aye.

Wheeldon had two bids for new roof on the Fire Hall. Bryon McMann $5,262.67, Lavigne Construction $5,924.20 metal roof, gutters extra $350.00. Lavigne Construction has liability insurance. Board asked Paul Fish from the Zoning Board if they could put metal roof on and they said it was okay. Motion by Sailors, seconded by Wheeldon to approve Lavigne Contractors bid for the fire roof. Hayes said some holes need filled by bridge. Board has had some other troubled places around town filled and repaired.

Harold Nichols asked the board if he could get the money Abernathy owes him for his work now that he is done. Wheeldon said he makes a motion to pay Nichols for his work done. Hayes said that Nichols has to turn a bill in to Abernathy and then Abernathy turns it in to the board for the payment. The board can not write a check out for just Nichols as Abernathy is the contractor and he will pay the sub-contractors for their work. Harold told the board that it shows on the plans that Abernathy had gave the extra length that he had added. Nichols didn’t have his plans with him, but will get them to the board. Board members agreed to look at Abernathy plans to see if his plans were the same as the one Nichols have. Clerk to write to Abernathy to have him remit the bill for Nichols work $7,625.75, plus the additional change order for $825.75 for the total of $8,451.50. Nichols turned in a bid for the additional work on the basement part of the concrete entrace. The board and Nichols discussed on what the village wanted for the concrete entrance. The board said they would let Nichols know when they decide on how wide they want the entrance to the basement.
Paul Fish that the Planning and Zoning Board said that the plans for the Theater was okay and gave a letter to the board and for Harper for their approval of the project. Clerk to send Harper a copy of the letter.
Board member Jim Doty resigned from the board. Motion by Hansen, seconded by Wheeldon to approve the resignation of Jim Doty. Roll Call: Hansen yea, Sailors yea, Hayes yea, Wheeldon yea. All yea votes. Motion carried. Hayes told the board they have to nominate a board member for the Water commissioner to attend their monthly meetings. Motion by Hayes, seconded by Wheeldon to have Hansen as water commissioner to attend the monthly meetings. Roll Call: Wheeldon yea, Hayes yea, Sailors abstain, Hansen yea. Three yea votes, one abstain. Motion carried. Motion by Hayes, seconded by Hansen to approve Paul Fish to take Doty remaining time on the board.
