MINUTES OF THE BOARD OF EQUALIZATION OF NEMAHA COUNTY, NEBRASKA
MARCH 24, 2010
Board of Equalization of the County of Nemaha, State of Nebraska met on March 24, 2010 Commissioners Chambers, Nemaha County Courthouse, Auburn NE. Notice of meeting published in the Nemaha County Herald on March 18, 2010.  The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website ( HYPERLINK “http://www.nemahacounty.ne.gov” www.nemahacounty.ne.gov).  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Equalization.  The Board of Equalization has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Randy Rohrs called the meeting to order at 11:12 a.m.  Present for the meeting were:
Commissioner District 1 Bob Hutton, Commissioner District 2 Monty Lovelace, Commissioner District 3 Randy Rohrs, County Clerk Joyce Oakley and County Assessor Lila Gottula.

Chairman Rohrs noted the opening meeting law poster.
Assessor Lila Gottula presented tax list correction #934, parcel 640067638 for Rieken Construction, listed a D6R Cat. Dozer in error on 2008 personal property listing depreciation schedule, was checked 3/9/10, 2008 tax year, credit $761.56 tax.  Motion by Lovelace, seconded by Hutton to approve tax list correction for Rieken Contruction, 2008 personal property D6R Cat Dozer in the amount of $761.56 credit.  Roll call vote: Lovelace, aye; Rohrs, aye; Hutton, aye.
Assessor Lila Gottula presented tax list correction #935, parcel David & Nancy Baltensperger, Vermeer 605 M Baler (purchased in 2004) left on return but was traded in 2008 for a new Vermeer 605M Baler, credit $286.40 tax.  Motion by Hutton, seconded by Lovelace to approve tax list correction #935 for David & Nancy Baltenperger, 2008 personal property Vermeer 605M Baler the amount of $286.40 credit.  Roll call vote: Hutton, aye; Rohrs, aye; Lovelace, aye.
Assessor Lila Gottula presented tax list correction #936, parcel Rieken Construction, listed a D6R Cat. Chairman Lovelace noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.
Public notice was published in the Nemaha County Herald on March 11, 2010 and March 18, 2020 to receive sealed bids for replacement of 2 heating and air conditioning rooftop units at the Nemaha County Law Enforcement Bldg.  The following sealed bids were received and publicly opened in the presence of the bidders: Bohl Plumbing & Heating, Inc.:  $15,708.00; Borrenpohl Plumbing, Heating & Air Conditioning $15,447.00; Control Services Inc. $19,300.00, Hail Guard $865.00; Auburn Plumbing, Heating & A/C Inc. $13,350.00, 13 Seer Package; $17,475.00 17 Seer package, Hail Guards $600.00 for the 17 Seer package, Economizer Package, $2,400.00.  Motion by Rohrs, seconded by Hutton to accept the bid from Auburn Plumbing & Heating for 13 Seer Package $13,350.00, with bid price to be possibly lowered, if local options for use of a crane is utilized.  Roll call vote:  Rohrs, aye; Hutton, aye; Lovelace, aye.
Kermit Moore, COO, Nemaha County Hospital presented a price quote in the amount of $128,578.67 for a Gastroenterology System for the Nemaha County Hospital.  Motion by Hutton, seconded by Rohrs to ratify the purchase of the Gastroenterology System in the amount of $128,578.67 as recommended by the Nemaha County Hospital Board.. Roll call vote: Lovelace, aye; Hutton, aye, Rohrs, aye.
The following fuel bids for April, 2010 were received:  Lueders Petroleum #2 Diesel $2.683, Unleaded $2.703; Farmers Coop #2 Diesel $2.64, Unleaded $2.69.  Motion by Rohrs, seconded by Hutton to award the fuel bid for the month April, 2010 to Farmers Coop for #2 Diesel $2.64 and Regular Unleaded $2.69.  Roll call vote:  Rohrs, aye; Hutton, aye; Lovelace, aye.

CONSULTANTS
The Auburn Airport Authority, Auburn, Nebraska is hereby soliciting statements of qualifications and experience from airport consultants for projects at Farington Field. Subject to receipt of Federal funding, these projects may include the following:
1. Pave and light runway.
2. Pave and light taxiways, turnarounds, and aprons
3. Airfield lighting improvements
4. Hangars and other buildings
5. Airport Layout Plan (ALP) updates
6. Associated work items and general airport engineering
The required services include, but are not limited to, A/E services for planning, preliminary, design, bidding and construction phases including incidental special services for projects funded under the FAA Airport Improvement Program for the next 5 year period.
A qualification based selection process conforming to FAA Advisory Circular 150/5100-14d will be utilized. Fee information will not be considered in the selection process and should not be submitted with the statement of qualifications. Selection Criteria will include: Recent experience on similar airport projects; Capability to perform all aspects of project; Ability to meet schedules within budget; Quality of previous airport projects; Interest shown; Consultant Qualifications; and Reputation; including references.
Fees will be negotiated for projects as federal funds become available.

PUBLIC NOTICE
REQUEST FOR BIDS
The Board of Commissioners of the County of Nemaha, Nebraska will receive sealed quotes at the office of the Nemaha County Clerk until April 14, 2010, 8:30 a.m. for 2 -  dehumidifiers (90 pint/per day, 115 volt).  Quotes must also include wiring for 2 - 110 volt outlets. These dehumidifiers will be placed in the basement of the Multi-Plex Bldg.
Receipt of quotes must be submitted by 8:30 a.m., on the 14th day of April, 2010 and immediately thereafter such quotes will be simultaneously opened publicly and in the presence of the bidders or representatives of the bidders. All quotes must be submitted in a sealed envelope and marked on the outside “dehumidifiers.”
The County of Nemaha, Nebraska reserves the right to waive informalities and to reject any or all bids.  No bidder may withdraw their bid for a period of 30 days after the time of receiving bids.  Awarding will be in accordance with Section #10 of LB 393 known as the County Purchasing Act.

Notice of Taking Bids for Asbestos Abatement on Residential Property that is targeted for
demolition –
City of Auburn
NSP1 Bid Round #2
You are hereby notified that the City of Auburn is taking bids for the complete asbestos abatement  of 4 residential properties that are targeted for demolition.  All four properties are located on sites scattered  within the City of Auburn, Nebraska.
Bids must be received by the City Clerk’s office, City of Auburn, 1101 “J”  Street, Auburn, NE 68305 on or before 8:30 AM on Tuesday 4-6-2010. At which time bids will be publicly opened and tabulated for presentation to the City of Auburn City Council.  It is anticipated that the City Council will take action on said bids at the 4-12-2010 City Council meeting, and has a goal of these 4 units of asbestos abatement being completed by 6-1-2010.
Bidders should obtain from the City Clerk’s office at the City of Auburn, Nebraska the Project Specifications and bid forms for Asbestos Abatement on Residential Property that is targeted for demolition – City of Auburn NSP1 Bid Round #2 prior to submitting their bids.
NOTE: The 4 properties in this Bid Round #2 have had an inspection for asbestos containing materials completed by SAS Environmental and were found to contain asbestos containing materials.  This activity is being funded via the HUD Neighborhood Stabilization Program and as such has specific standards and documentation requirements.  Demolition and site clearance of these properties will take place at a later date under a separate contract.

The Board of Education of School District #29 of Nemaha County, Nebraska met on March 23, 2010 at the Auburn City Hall for a special board meeting.  Notice of the meeting was posted at Carson National Bank, Auburn State Bank, Nemaha County Courthouse and the Central Office.
Beth Kernes Krause called the special meeting to order at 5:02 p.m.   It was noted that the Opening Meetings Law poster was on display at the meeting.  Roll call of members present were: Kernes Krause, Kennedy, Billesbach, Oestmann and Hemmingsen.  Zaruba was absent.  
Motion by Kennedy and second by Oestmann to approve the agenda as presented.  Roll call vote:  Kennedy (yes), Billesbach (yes), Oestmann (yes), Hemmingsen (yes) and Kernes Krause (yes).   Motion carried 5-0.
Visitors included: Amy Kroll and the Administrators.
Motion by Kennedy and second by Hemmingsen that the Board approve opening the pre-school for the 2010-2011 school year.  
Motion by Kennedy and second by Hemmingsen to amend motion to table approving to open the pre-school for the 2010-2011 school year until information is provided on the grant.   Roll call vote:  Billesbach (yes), Oestmann (abstain ), Kernes Krause (yes), Hemmingsen (yes) and Kennedy (yes).  Motion carried 4-0-1.
Motion by Hemmingsen and second by Oestmann that the Board approve hiring Dennis Ehmke as a middle school music teacher beginning in the 2010-2011 school year.  Roll call vote:  Billesbach (yes), Oestmann (yes), Kernes Krause (yes), Hemmingsen (yes) and Kennedy (yes).  Motion carried 5-0.

City Council Proceedings
March 15, 2010
The Mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on March 15, 2010, at 5:00 o’clock P.M. in Special Meeting, open to the general public.
The meeting was called to order by Mayor Robert B. Engles.  Upon roll call, the following members of the City Council were present:  Snyder, Wittmann, Critser, Erickson, and Holtzman.  Absent:  Thomas.  
Mayor Engles announced that the Open Meetings Act is posted on the North wall of the Chambers by the entrance door.
Council approved the agenda.
The purpose of the meeting being to consider NSP1 Grant #095-ND-38 Demolition and Clearance of Residential Property Bid Round #1 bids and action on related contracts, the Mayor and City Council reviewed the bids.  A written recommendation from the Keep Auburn Beautiful Committee was presented and Council Member Wittmann provided an overview.  As per the recommendation of the KAB Committee, the City of Auburn awarded NSP1 Bid Round Demo Project #1 to Jim Winkelman dba Winkelman Construction for $7,200 per bid, and awarded Demo Project #5 to David Rieger for $7,200 per bid, all subject to the City Attorney approval as to contract form.  
There being no further business to come before the Mayor and Council, the City Council adjourned.

The City Council approved the Nemaha Well Field Protection area as shown on the Auburn East Well Field Nemaha County Provisional Map dated January 2010.
Approval was given for SAS Environmental to perform asbestos inspection services for NSP1 Demolition Project #095-ND-38.
City staff and Southeast Nebraska Development District staff were given authorization to proceed with this first round of two NSP Demolition Projects.
Public hearing was held on the Proprietary Function Reconciliation Statement presented by the Board of Public Works in accordance with Nebraska Revised State Statute 18-2807.  Following the public hearing, the City Council approved the Board of Public Works Proprietary Function Reconciliation Statement and authorized the publication of said statement.
NSP1 #095-ND-38 Drawdown #2 and the related claims were approved as presented.
Discusssion was held to consider using approximately $30,000 of CDBG ReUse ED funds to assist with the purchase of the former John George property (located at the intersection of Q Street and 730th Road).  With five Council Members (Holtzman, Snyder, Wittmann, Erickson, Thomas) voting in favor and one Council Member (Critser) voting in opposition, the City Council gave authorization for the development of a full application and Memorandum of Understanding for formal consideration and action at a later date.  
It was noted that Agenda Item No. 17 was not necessary as the City has previously approved an ordinance (Ordinance No. 7-92) thereby satisfying the requirement to have a policy opposing discrimination in the acquisition, ownership, possession or enjoyment of housing; to assist aggrieved person in filing complaints by providing certain information.
The City Council approved execution of the easement by the Mayor from Armstrong Wood Products to the City of Auburn.
Reports were given by department heads from the following areas:  police department, fire department, library, and city services.   A written report was provided showing sales tax receipts.  
Public hearing was held concerning an application to the Department of Economic Development (NeDED) for a Community Development Block Grant.  Following the public hearing, with five Council Members (Holtzman, Snyder, Wittmann, Erickson, Thomas) voting in favor and one Council Member (Critser) voting in opposition, the mayor was authorized to sign an application for CDBG Funds & execute all documents for a CDBG Downtown Revitalization Phase 1 Grant by the passage and adoption of Resolution No. 3-10.
Public comment was received and discussion was held concerning the possibility of having a city administrator position.
The following committees presented reports:  Keep Auburn Beautiful, Budget/Finance, and Legislative.  A written financial report was provided from the Community Redevelopment Authority.  
There being no further business to come before the Mayor and Council, the City Council adjourned.
