County Board of Commissioners of the County of Nemaha, State of Nebraska met on January 9, 2013, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on January 3, 2013. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
County Clerk Oakley called the meeting to order at 8:05 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley.
County Clerk led the Pledged of Allegiance.
County Clerk Oakley noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.

Motion by Wittmann, seconded by Bohling to approve the agenda as presented.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.
County Clerk Oakley called for nominations for Chairman for 2013.  Wittmann nominated Hutton for chairman of Nemaha County Board of Commissioners for 2013.  Motion by Wittmann, seconded by Bohling that nominations cease and elect Hutton as Chairman Nemaha County Board of Commissioners for 2013.   Roll call vote: Wittmann, aye; Hutton, aye; Bohling, aye.
Chairman Hutton called for nominations for Vice Chairman for 2013. Wittmann nominated Bohling for vice chairman for Nemaha County Board of Commissioners for 2013. Motion by Bohling, seconded by Hutton that nominations cease and elect Bohling as Vice Chairman for 2013.  Roll call vote: Bohling, aye; Wittmann, aye; Hutton, aye.  
Motion by Bohling, seconded by Wittmann to approve the December 27, 2012 regular scheduled meeting minutes with no corrections.  Roll call vote: Wittmann, aye; Bohling, aye; Hutton, aye.  
Motion by Wittmann, seconded by Bohling to approve the accounts payable claims as presented by the County Clerk and authorized for payment by the Board of Commissioners.  Roll call vote: Bohling, aye; Hutton, aye; Wittmann, aye.
Motion by Bohling, seconded by Wittmann the county will provide 1 30’ driveway culvert entrance (with all applications approved by the Board of Commissioners) with any additional footage to the culverts, as requested by the landowners/tenants and approved by the Board of Commissioners, the cost of the additions to the driveway entrances to be provided for by the county and paid for by the landowners/tenants.  No culverts and bands will be provided by Nemaha County for private use.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
Motion by Wittmann, seconded by Bohling to appoint Nemaha County Herald as official newspaper for Nemaha County for 2013.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.
Motion by Wittmann, seconded by Bohling to approve the application for Under Crossing County Road with an electrical line in Section 34T4N R13E for Craig Behrends.  Roll call vote:  Bohling, aye; Wittmann, aye; Hutton, aye.
Motion by Bohling, seconded by Wittmann to reappoint Bob Hutton as representative to SENCA board for the term January, 2013 to January, 2016.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
Motion by Wittmann, seconded by Bohling to use Nemaha County’s Website as additional official public notice for meetings. Roll vote:  Hutton, aye; Bohling, aye; Wittmann, aye.
Motion by Bohling, seconded by Wittmann to adopt Resolution 2013-01 approving the subdivision of a 3.16 acre tract of land in Section 27 T6N R13E for Aron Hawley.  Roll call vote:  Bohling, aye; Hutton, aye; Wittmann, aye.
Motion by Wittmann, seconded by Bohling to adopt Resolution 2013-02, request from Wayne Koehler to close or vacating county road#208 between Sections 31 & 32 T4N R13E, and to appoint Mark Mainelli, Mainelli Wagner & Associates to conduct a study of use being made of such public road.  Roll call vote:  Bohling, aye; Wittmann, aye; Hutton, aye.

Equalization meeting
January 9, 2013
Board of Equalization of the County of Nemaha, State of Nebraska met on January 9, 2013 Commissioners Chambers, Nemaha County Courthouse, Auburn NE. Assessor Smith presented the following tax list corrections:
1301-01 Brian Moody, personal property schedule was brought in December 19, 2012 (due to tax extension), additional made to 2012 property listing.  Motion by Bohling, seconded by Hutton to approve tax list correction for Brian Moody in the amount of $2,260.92 added tax.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
1301-02 Farmers Bank of Cook, parcel was purchased by Farmers Bank of Cook 6-9-11, property ownership however was not changed in computer (2011 taxes were paid by Farmers Bank of Cook).  Motion by Bohling, seconded by Hutton to approve tax list correction for Farmers Bank of Cook in the amount of no tax (taxes paid are current.)  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.
1301-03 Dennis & Rene Meyer, clerical error, split was not processed and therefore Dennis & Rene Meyer did not receive a tax statement on tract of land.  Motion by Hutton, seconded by Bohling to approve tax list correction for Dennis & Rene Meyer in the amount of $74.64 added tax.  Roll call vote:  Hutton, aye; Bohling, aye; Wittmann, aye.
1301-04 Judy Koch & Dennis Meyer, clerical error, split was not processed and therefore Judy Koch & Dennis Meyer did not receive a tax statement on tract of land.  Motion by Hutton, seconded by Bohling to approve tax list correction for Judy Koch and Dennis Meyer in the amount of $74.64 deducted tax.  Roll call vote: Wittmann, aye; Bohling, aye; Hutton, aye.
