MINUTES OF A REGULAR MEETING OF THE MAYOR AND CITY COUNCIL OF PERU, NEBRASKA ON OCTOBER 9, 2012 AT 7:00 P.M.
Present were: Mayor Lesley Ryan and Council Members: Ken Hastings, Joe Whisler, Jay Moran and Judie Douglas. Upon roll call by the City Clerk, a quorum was declared. Other members of the public were also present.
Mayor Ryan called the meeting to order and informed the public of the location of the posting of the Nebraska Open Meetings Act.
The Council reviewed the minutes from the September 10, 2012 regular Council Meeting. Council Member Whisler made motion to accept the minutes as written. Council Member Moran seconded the motion for acceptance. Vote indicated: “AYE” All. Motion: Carried.
Council Member Hastings made motion to accept the minutes from the September 25, 2012 Budget Hearing. Motion was seconded by Council Member Whisler. Vote indicated: “AYE” Moran, Hastings, Whisler. “ABSTAIN” Douglas. Motion: Carried.

Regarding Agenda Item #1, Peru State College President Dan Hanson was present to give the Council an update on the Oak Bowl project.
Regarding Agenda Item #2, Approval of Peggy Kuser’s Engagment Letter, Council Member Hasting’s mentioned Peggy Kuser’s increase of $100.00 per month to perform accounting services. Mayor Ryan stated the rates have not increased for many years and believes the increase is justifiable. Council Member Hastings made motion to approve Peggy Kuser’s engagement letter for 2012-2013 which includes the preparation of the 2013-14 City Budget. Motion was seconded by Council Member Moran. Vote indicated: “AYE” All. Motion: Carried.
Regarding Agenda Item #3, street sweeper attachment purchase or rent, Mayor Ryan stated she thought the streets looked beautiful for homecoming. Council Member Moran stated the gutter broom attachment was not used and that it would actually help do a better job. After further discussion, Council Member Hastings made motion to purchase the street sweeper attachment which includes the gutter brush for $4,500.00. Motion was seconded by Council Member Whisler. Vote indicated: “AYE” All. Motion: Carried.
Regarding Agenda Item #4, Water Rate Increase, Mayor Ryan asked the City Clerk to further explain the need for the increase. The City Clerk explained Nebraska Rural Water Association performed a study on March 29, 2012 at the City Office and determined that in order for the City of Peru to pay for its’ existing debt at the water plant they would need to raise their rates. The Clerk stated this does not include future construction projects. After further discussion, Council Member Hastings made motion to approve water rate increase option B which is an increase of the base rate from $13.50 per month to $18.00 per month and the per 1,000 gallon charge from $3.25 to $4.30. Motion was seconded by Council Member Moran. Vote indicated: “AYE” Moran, Douglas, Hastings. “NAY” Whisler. Motion: Carried.
Regarding Agenda Item #5, the Clerk explained she spoke with Cay Ewoldt with Nebraska Department of Environmental Quality regarding our NPDES permit and their correspondence regarding upgrades they are requiring be made at the water plant. The State is giving the City of Peru one (1) year to design a plan for a detention system for total suspended solids with regard to filter backwash discharge and then one (1) year to implement the plan. The Clerk stated we probably need to talk to Evan Wickersham with JEO and ask that he come up with a plan. Discussion followed.
Regarding Agenda Item #6, Council Member Whisler made motion to accept Koby Brennan, Alexander Bratt and Michael Casavant as new fire department members. Motion was seconded by Council Member Moran. Vote indicated: “AYE” All. Motion: Carried.
Regarding Agenda Item #7, approve Moran Bros. Excavating as Contractor of Choice for Emergency Infrastructure Problems, discussion followed with no action until after the election.
Regarding Agenda Item #8, consideration of hiring Angelo Liguori as City Attorney, lengthy discussion to place. The Clerk stated this was a discussion item only and no action could be taken and we will choose our attorney during the December meeting.

NOVEMBER 28, 2012
County Board of Commissioners of the County of Nemaha, State of Nebraska met on November 28, 2012, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting. Notice of meeting published in the Nemaha County Herald on November 22, 2012. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website. The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners. The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Hutton called the meeting to order at 8:00 a.m. Present for the meeting: Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley.

Bob Hilske, Director of Nemaha Natural Resource District was present to discuss replacing the landowners fencing on Buck Creek project. The cost of replacing the fencing will be split 50% county and 50% NRD. NRD will advertise for bids next spring.

Board of Commissioners met with the county employees to discuss initiating direct depositing employee wages. Sue Brewer and Theresa Shelton, Carson National Bank visited with the employees regarding direct depositing employees paychecks. Present: Randall Simon, Bruce Sherman, Ross Helms, Brian Bohling, Walt Boring, Greg Cook, Don Mathers, Randy Rohrs, Rick Helms and Jana Smith.
Dylan Handley Deputy County Attorney visited with the board regarding isolated lands. Handley told the board the land owner needs to petition to the board they can’t get to their land before anything can be done by the board.
Peru State College President Dr. Dan Hansen, City of Peru representatives Jay Moran and Ken Hastings presented the board with the proposed ‘Park Avenue Project’ that is being cosponsored with Peru State College, Peru State College Foundation and City of Peru. The project will involve widening Park Street and adding a 10 ft. sidewalk from the south end of Peru starting at Casey General Store, north to the Little Red School House located on Peru State College Campus.
Brenda Wilson, representative from GIS Workshop presented the upgrade of the GIS Workshop mapping technology for Nemaha County to the Board of Commissioners. Wilson explained to the board the upgrade of this existing site is necessary due to recent outages that occurred with the old system technology. The new mapping technology will provide a better platform to maximize the county’s investment in GIS data development and will be added to the current website for public use. Wilson also explained because Nemaha County has had previous contracts with GIS the initial setup costs of the Assessor tab will be waived ($4,800.00) and GISW will honor the existing rates for the current budget year.
Motion by Wittmann, seconded by Bohling to authorize County Assessor Jana Smith to sign the Agreement for the Provision of Limited Professional Services with GIS Workshop in the annual amount of $2,500.00 (due on July 1, 2013). Roll call vote: Hutton, aye; Wittmann, aye; Bohling, aye.

MINUTES OF THE NEMAHA COUNTY BOARD OF
EQUALIZATION MEETING
NOVEMBER 28, 2012
Board of Equalization of the County of Nemaha, State of Nebraska met on November 28, 2012 Commissioners Chambers, Nemaha County Courthouse, Auburn NE. Notice of meeting published in the Nemaha County Herald on November 22, 2012. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website ( HYPERLINK “http://www.nemahacounty.ne.gov” www.nemahacounty.ne.gov). The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Equalization. The Board of Equalization has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman called the meeting to order at 11:38 a.m. Roll call: Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling, County Clerk Joyce Oakley and County Treasurer Pat Holtzman.
Chairman Wittmann noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.
Motion by Hutton, seconded by Bohing to approve the agenda as presented. Roll call vote: Hutton, aye; Wittmann, aye; Bohling, aye.
Motion by Bohing, seconded by Hutton to approve the November 14, 2012 minutes as presented with no corrections. Roll call vote: Bohling, aye; Wittmann, aye; Hutton, aye.
Chairman Wittmann opened the Public Hearing on Motor Vehicle Exemptions at 11:39 a.m. for Hearts United for Animals on a 2005 Chevrolet pickup. Notice of public hearing was published in the Nemaha County Herald on November 8, 2012. The following were present at the public hearing: Commissioners: Bob Hutton, Dennis Wittmann, and Marvin Bohling, County Clerk Joyce Oakley, Treasurer Pat Holtzman, Renee Critser, Dottie Holiday, Scott Kudrna, and Dave Swanson. No one was present to oppose the Motor Vehicle exemption for Hearts United for Animals on a 2005 Chevrolet pickup.
Chairman Wittmann closed the public hearing at 11:40 a.m.
Motion by Bohling, seconded by Hutton to approve the Application on Motor Vehicle Tax Exemption, Form 457 for Hearts United for Animals on 2005 Chevrolet pickup. Roll call vote: Hutton, aye; Wittmann, aye; Bohling, aye.
