PROCEEDINGS OF THE NEMAHA COUNTY

COMMISSIONERS MEETING

AUGUST 22, 2012

County Board of Commissioners of the County of Nemaha, State of Nebraska met on August 22, 2012, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on August 16, 2012. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting. 

Chairman Hutton called the meeting to order at 8:30 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley. 

Chairman Hutton noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.

Motion by Bohling, seconded by Wittmann to approve the agenda as presented.  Roll call vote:  Wittmann, aye; Bohling, aye; Hutton, aye.  

Motion by Wittmann, seconded by Bohling to approve the August 8, 2012 regular scheduled meeting minutes with no corrections.  Roll call vote:  Bohling, aye; Wittmann, aye; Hutton, aye.

Motion by Wittmann, seconded by Bohling to approve the claims for payment as presented by the County Clerk and authorized for payment by the Board of Commissioners.  Roll call vote:  Hutton, aye; Bohling, aye; Wittmann, aye. 

Brent Lottman and Mark Boellstorff visited with the board regarding the MFO 2012 levy.  Motion by Wittmann, seconded by Bohling to adopt Resolution 2012-28 setting the 2012 MFO levy at .035377 and 2012 Agricultural Society levy at .006133.  Roll call vote:  Bohling, aye; Wittmann, aye; Hutton, aye.

Marcia Reeves visited with the board regarding her request for temporary closing county road 646 Ave from 733 road to 734 road.  She requested the closing so her cattle could get to the water on the other side of the road.  Board told Marcia Reeves she could temporarily place cattle gates on the road so long as they are manned by someone at all times when the gates are closing the road.

Motion by Bohling, seconded by Wittmann to approve the 2012 County Officials and Office Directors Inventories.  Roll call vote:  Hutton, aye; Bohling, aye; Wittmann, aye.

The following fuel bids for September, 2012 were received:  Lueders Petroleum No. 2 Diesel $3.865, Unleaded $3.555; Farmers Coop No. 2 Diesel $3.81, Unleaded $3.51.  Motion by Wittmann, seconded by Bohling to award the fuel bid for the month of September, 2012 to Farmers Coop.  Roll call vote:  Wittmann, aye; Bohling, aye; Hutton, aye.

Motion by Wittmann, seconded by Bohling to the approve the Amendment Agreement dated August 22, 2012 with the City of Auburn on the Law Enforcement Contract, changing the rent to $50,000.00 per year for Oct. 1, 2012 through Sept. 30, 2014; $51,000.00 per year for the period Oct. 1, 2014 through Sept. 30, 2015.  Roll call vote:  Bohling, aye; Wittmann, aye; Hutton, aye.

Motion by Bohling, seconded by Wittmann to approve Amendment #1 Nemaha County Ave #643 Agreement with Nemaha Natural Resource District on Buck Creek Watershed Structure.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.

Motion by Wittmann, seconded by Bohling to approve Amendment #1 Nemaha County Ave #735 Agreement with Nemaha Natural Resource District on Buck Creek Watershed Structure.  Roll call vote:  Bohling, aye; Hutton, aye; Wittmann, aye.

Motion by Wittmann, seconded by Bohling to approve Permit 2012-06 issued to Great Plains Communications for installation of fiber optic cable on designed county roads right of way in Nemaha County.  Roll call vote:  Hutton, aye; Bohling, aye; Wittmann, aye. 

Motion by Bohling, seconded by Wittmann to approve Windstream application to install communications facilities between Sections 18 T4N R14E & 13 T4N R13E.  Roll call vote:  Wittmann, aye; Bohling, aye; Hutton, aye.

Motion by Wittmann, seconded by Bohling to approve Windstream application to install communications facilities between Sections 8 T6N R14E & 17 T6N R14E.  Roll call vote:  Bohling, aye; Hutton, aye; Wittmann, aye.

Motion by Wittmann, seconded by Bohling to approve the Omaha Public Power District application to install single phase overhead, 1 mile south and 1 mile west of Peru.  Roll call vote:  Hutton, aye; Bohling, aye; Wittmann, aye.

Motion by Bohling, seconded by Wittman to adopt Resolution 2012-29 vacating county road #49 beginning 2,640 ft west of the SE corner of Section 5 T6N R13E, west to the east bank of the Nemaha River.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.

Motion by Wittmann, seconded by Bohling to approve writing a letter of support to the Nebraska Environmental Trust on the invasive weed grant application for Five Rivers Weed Management.  Roll call vote:  Bohling, aye; Wittmann, aye; Hutton, aye.

Motion by Wittmann, seconded by Bohling the approve the application for road entrance requested by Hawley Farms in Section 34 T6N R13E.  Roll call vote: Hutton, aye; Wittmann, aye; Bohling, aye.

Motion by Wittmann, seconded by Bohling to adopt Resolution 2012-29 approving the subdivision of 1.89 acres tract of land for Ella Bergmann Living Trust in Section 12 T4N R13E.  Roll call vote:  Wittmann, aye; Bohling, aye; Hutton, aye.

NOTICE TO CONTRACTORS

Notice is hereby given that there are on file with the Clerk of the Village of Johnson, Nebraska, proposed Drawings, Specifications, form of Contract, and estimated costs for the construction of improvements to THE SPORTSMAN’S PARK BALLFIELD COMPLEX, JOHNSON, NEBRASKA – NPS PROJECT NO. 31-01014

Sealed bids for the construction of said improvements will be received by the Village of Johnson at the Village Office in Johnson, Nebraska, until 9:00 a.m. September 21, 2012, and will be opened and publicly read by the Village of Johnson Board of Trustees or their representative within seven days.

Federal Funds will be used to assist with the development of this project.

The general nature of the work is described as follows:

Project Contract No. 1 – Lighting

Construction of a lighting system for one ballfield with a 300-foot radius and delivering a minimum of 30/20 footcandles of illumination.

Project Contract No. 2 – Ballfield Fencing

Extension of backstop fencing on two ballfields and construction of new fencing                           for a batting cage.

All work and equipment is to be in accordance the Drawings, Specifications, and Contract Documents on file with the Clerk of the Village of Johnson, Nebraska, which are, by this reference, made a part of this Notice as though fully set out and incorporated herein.

Work under the proposed Project Contracts shall commence within ten calendar days from the date of the Notice to Proceed, and the work shall be substantially completed on or before November 15, 2012, subject to any extension of time which may be granted by the Village of Johnson.
