MINUTES of SPECIAL
MEETING
April 18, 2012
Notice of the meeting was given in advance by publication and/or posting in accordance with the Board approved method for giving notice of meetings. Notice of this meeting was given in advance to all members of the Board of Education. Availability of the agenda was communicated in the publicized notice and a current copy of the Agenda was maintained as stated in the publicized notice. All proceedings of the Board of Education, except as may be hereinafter noted, were taken while the convened meeting was open to attendance of the public.
1.     CALL TO ORDER:
At the beginning of this meeting, the chairperson announced and informed the public that a current copy of the Open Meeting Act is posted on the North wall of the meeting room. President Bob Hemmingsen called the special meeting to order at 7:00 PM at the Boardroom. Those members present: Beth Kernes Krause, JaNay Oestmann, Stephen Kennedy, Bob Hemmingsen and Dr. Mike Zaruba.  Kevin Reiman, Secretary of the Board was also present. Barb Billesbach was absent.

STUDENT DISCIPLINE
APPEAL HEARING:
Motion was made by Zaruba and seconded by Kernes Krause that the Board hold a closed session for the purpose of conducting a student discipline hearing, the same being authorized by law and clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual.  The student’s attorney stated she had no opposition to the hearing being held in closed session.
After discussion and on roll call vote, the Board voted as follows:
Voting for:  Bob Hemmingsen, Stephen Kennedy, Dr. Mike Zaruba, JaNay Oestmann, Beth Kernes Krause.
Voting against: None
Not Voting:  None
The motion carried.
The Board went into closed session at 7:02 p.m.  Immediately prior to the closed session the presiding officer restated on the record the limitation of the subject matter of the closed session.
An appeal hearing was conducted pursuant to law with regard to a student discipline matter.  Evidence was offered and received and arguments given by the attorneys.  
The hearing was concluded. The Board withdrew to deliberate privately upon the Case Record and any new evidence received.  The deliberations were held in the presence only of board members in attendance at the appeal proceeding.
The Board reconvened in open session at 8:28 p.m. before any formal action was taken.
It was moved by Kennedy and seconded by Zaruba that the final action of the Board on the student discipline appeal hearing be as set forth in decision letter “A.”
Those voting in favor of the motion were: Bob Hemmingsen, Stephen Kennedy, Dr. Mike Zaruba, JaNay Oestmann, Beth Kernes Krause.
Those voting against were:  None
Those abstaining or not voting were:  None
The motion carried.  The final action and decision letter was signed by the Chairperson and the Superintendent was directed to serve a copy of the final action and decision letter on all parties as required by law.
President Bob Hemmingsen adjourned the meeting at 8:30 p.m.

Notice is hereby given that the Auburn Airport Authority (Authority) will conduct a public hearing on May 17, 2012 at 5:00 p.m. in the City Council Chambers, City Hall, 1101 “J” Street, Auburn, Nebraska.
It is the Authority’s intent to undertake the following proposed action at Farington Field:  1) Acquire land in fee (Tracts 13B and 14B); 2) Drain pond (which may require grading).
