PROCEEDINGS OF THE NEMAHA COUNTY BOARD OF COMMISSIONERS MEETING
OCTOBER 26, 2011
County Board of Commissioners of the County of Nemaha, State of Nebraska met on October 26, 2011, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on October 20, 2011. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Hutton called the meeting to order at 8:03 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley.
Chairman Hutton noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.

Motion by Wittmann, seconded by Bohling to approve the agenda as presented.  Roll call vote: Bohling, aye; Wittmann, aye; Hutton, aye.
Motion by Wittmann, seconded by Bohling to approve the October 12, 2011 regular scheduled meeting minutes with no corrections.  Roll call vote: Wittmann, aye; Bohling, aye; Hutton, aye.
Motion by Bohling, seconded by Wittmann to approve the claims for payment as presented by the County Clerk and authorized for payment by the Board of Commissioners.  Roll call vote: Hutton, aye; Bohling, aye; Wittmann, aye.
James Slatten, Magellan Pipeline visited with the board regarding moving existing soil downgrade to provide sufficient cover over 2 existing petroleum pipelines on 720 road 1,500’ east of 647 Ave., pour a 20’x25’x6” concrete pad over lines, add rip rap to sides and then place dirt over the pad. Motion by Wittmann, seconded by Bohling to approve Permit #2011-07 to Perform Work on Public Right of Way for Magellan Pipeline and to install a concrete pad over petroleum lines on 720 Road.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.
The following fuel bids for November, 2011 were received:  Lueders Petroleum No. 2 Diesel $3.595, Unleaded $3.225; Farmers Coop No. 2 Diesel $3.545, Unleaded $3.146.  Motion by Bohling, seconded by Wittmann to award the fuel bid for the month November, 2011 to Farmers Coop  Roll call vote: Hutton, aye; Wittmann, aye; Bohling, aye.
Motion by Wittmann, seconded by Bohling to adopt Resolution 2011-41 Amendment & Addendum to NIRMA/NIRMAII Intergovernmental/Interlocal Agreements to recommit for membership in NIRMA for another 3 year period from July 1, 2012 through June 30, 2015.  Roll call vote: Bohling, aye; Hutton, aye; Wittmann, aye.  
Motion by Bohling, seconded by Wittmann to approve Omaha Public Power District application #161 to set pole in single phase primary overhead line, 2 miles east and .5 mile south of Brock for Dennis Jeanneret.  Roll call vote: Wittmann, aye; Hutton, aye; Bohling, aye.  
Motion by Bohling, seconded by Wittmann to approve Omaha Public Power District application #162 to install 3 spans primary overhead and set 3 poles in R-O-W 7 miles South and ½ mile west of Auburn for Willard Graber.  Roll call vote: Hutton, aye; Bohling, aye; Wittmann, aye  
Motion by Wittmann, seconded by Bohling to adopt Resolution 2011-42 approving the NDOR Combined Consultant Selection, NEPA, Uniform Act, Signing of Financial Management Systems Certification and authorizing the signature of the chairman of the Board of Commissioners for funding of Federal Aid Highway Bridge projects.  Roll call vote:  Bohling, aye; Wittmann, aye; Hutton, aye.
Motion by Wittmann, seconded by Bohling to adopt Resolution 2011-43 redistricting the Commissioner Districts to make them equal in size according to the 2010 census.  Roll call vote: Wittmann, aye; Hutton, aye; Bohling, aye.
Motion by Bohling, seconded by Wittmann to authorize the Nemaha County Sheriff to purchase a 2012 Dodge Charger from the state bid as soon as it is posted so long as it is less than $25,000.00 and to trade 2 sheriff vehicles if trade in value of $2,500.00 or more is received for each vehicle. Roll call vote:  Bohling, aye; Hutton, aye; Wittmann, aye.
Motion by Wittmann, seconded by Bohling to adopt Resolution 2011-44 approving the subdivision of a 5.95 acre tract of land in Section 30 T5N R14E for Charles Grotrian.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.
Motion by Wittmann, seconded by Bohling to authorize the chairman to sign NDOR’s Task Order Agreement for PE Services On-Call Wetland Delineation and Stream Delineation with Olsson Associates for Brock North ER-3675(7) Control 13145.  Roll call vote:  Bohling, aye; Hutton, aye; Wittmann, aye.

The City of Auburn is requesting proposals for the services of a licensed real estate auctioneer to sell real estate in Auburn Nebraska at public auction at a date and time later determined.

City Council Proceedings
September 26, 2011
The Mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on September 26, 2011, at 7:00 o’clock P.M., in Regular Meeting, open to the general public.
The meeting was called to order by Mayor Scott Kudrna.  Upon roll call, the following members of the City Council were present:  Billings, Bishop, Clark, Erickson and Holtzman. Absent:  Critser.

With Council Member Clark abstaining from the vote, and all other Council Members voting in favor, Council approved the claims which have not been previously approved by motion or resolution and ratified the ordinary and necessary expenses allowed and in accordance with Resolution No. 7-11 that was approved February 28, 2011.
Approval was given to the police department for Eric Adams to attend the Glock Armorers Course in Omaha and Kris Baker to attend the Phase I & II Hostage Negotiation Crisis Intervention training in Kansas City.  The request by the fire department for approval to allow 2 firemen to attend Interior Attack, Search & Rescue Techniques training on October 9th at Odell was also approved.
The City Council confirmed the reappointment of Irene Jones to the Auburn Housing Authority.
Public hearing was held to obtain public comment prior to consideration of an amendment to the redevelopment plan of the City of Auburn, including a specific Redevelopment project.  CRA attorneys Tom Huston and Andrew Willis with Cline Williams Wright Johnson & Oldfather, LLP and CRA Chairperson Stephanie Fisher provided information and answered questions regarding the resolution and amendment process.  There wasn’t any opposition to the amendment.  After the public hearing was closed, the City Council approved the amendment to the redevelopment plan of the City by the passage and adoption of Resolution No. 24-11.
Public hearing was held to set the final property tax request.  There was no opposition.  The final property tax request for fiscal year 2011-2012 was set by the passage and adoption of Resolution No. 25-11.
CDBG #09-HO-6047 “Citywide” Owner-Occupied Housing Rehabilitation Program Drawdown #17 and the related claims were approved.
The funding agreement with the Auburn Chamber of Commerce was approved by the passage and adoption of Resolution No. 26-11.
The passage and adoption of Resolution No. 27-11 approved the report of unpaid water accounts and authorized that said items be certified to the Nemaha County Clerk and filed as liens.
The passage and adoption of Resolution No. 28-11 approved the report of unpaid sewer accounts and authorized that said items be certified to the Nemaha County Clerk and filed as liens.
The City Council accepted the 3 year proposal of Massman Nelson Reinig to audit city funds.
The proposed contract for solid waste collection service between the City of Auburn and American Recycling and Sanitation Inc. was approved effective October 1, 2011.  With Council Member Clark voting against and all other Council Members voting in favor, proposed Ordinance No. 34-11 relating to solid waste collection was also approved.
With Council Member Clark voting against and all other Council Members voting in favor, proposed Ordinance No. 33-11, Fixing Compensation of the Officers and Employees of the City, was approved as presented.  
The City Council authorized the full and complete settlement of the Nemaha County District Court cases of Betty England vs City of Auburn by the passage and adoption of Resolution No. 29-11.
Reports were given by the following department heads:  library, street department, police department and City Treasurer.  Written financial reports were given on the sales tax receipts, investments, and operating expenditures in August 2011 compared to August 2010.
The following committees provided reports:  Street, and Economic Development.  A written financial report was provided by the Auburn Community Redevelopment Authority.
There being no further business to come before the Mayor and Council, the City Council adjourned.

UTILITY BUILDING FOR SALE
The Board of Public Works, Auburn, Nebraska will sell by sealed bids to the highest bidder:
Utility Storage Building that is 15 feet 8 inches in length, 11 feet 6 inches wide, and 11 feet 3 inches tall made from wood.  The building is located at 1310 27th Street and may be viewed by contacting the BPW.  The Utility Storage Building will be sold, as is condition at the time of the award date.  Awarded bidder will have the responsibility and all cost of relocating the building.  The building shall be paid in full and relocated within 10 days of receiving notice of award.    
Bids will be received  until 1:30 P. M., local time, November 11, 2011 at the Board of Public Works Offices, Auburn, Nebraska at which time and place all bids will be publicly opened and all bid prices read aloud for the sale of the Utility Storage Building.

You are hereby notified that the following-described property will be sold be Camille R. Hawk, Attorney at Law, Sucessor Trustee, at public auction to the highest bidder at the East front door of the Nemaha County Courthouse, in the City of Auburn, Nemaha County, Nebraska on November 17, 2011 at 10:00 a.m.:
Lot 7 and the South Half of Lot 8, Block 166, in Neal’s Addition to the Town of Peru, Nemaha County, Nebraska
and
The North Half of Lot 8 and all of Lot 9, Block 166, in Neal’s Addition to the Town of Peru, Nemaha County, Nebraska
commonly known as 921 7th St., Peru, NE.
The highest bidder will deposit with the Trustee, at the time of the sale, a personal or cashier’s check in the amount of $5,000.00, with the full purchase price, in certified funds, to be received by the Trustee by 5:00 p.m. on the day of the sale, except this requirement is waived when the highest bidder is the beneficiary. (If the sale is held after 1:00 P.M., the deposit requirement remains the same, and the full purchase price, in certified funds, shall be received by the Trustee by 5:00 p.m. the following business day.) The purchasher shall be responsible for all prior liens, all applicable fees, and all taxes, including the documentary stamp tax.
