Board of Equalization of the County of Nemaha, State of Nebraska met on September 28, 2011 Commissioners Chambers, Nemaha County Courthouse, Auburn NE. Notice of meeting published in the Nemaha County Herald on , 2011.  The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website ( HYPERLINK “http://www.nemahacounty.ne.gov” www.nemahacounty.ne.gov).  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Equalization.  The Board of Equalization has the right to modify the agenda to include items of an emergency nature only at such public meeting.

Treasurer Holtzman presented Exemption Application for Tax Exemption on Motor Vehicles, Form 457 for Catholic Social Services:  1987 Dodge Pickup. Motion by Bohing, seconded by Hutton to approve Motor Vehicle tax exemption for 1987 Dodge Pickup for Catholic Social Services.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
Treasurer Holtzman presented Exemption Application for Tax Exemption on Motor Vehicles, Form 457 for Evangelical Lutheran Good Samaritan Society Home Care of Southeast Nebraska for a 2011 Chevrolet Impala. Motion by Bohling, seconded by Hutton to approve Motor Vehicle tax exemption for Evangelical Lutheran Good Samaritan Society Home Care of Southeast Nebraska for a 2011 Chevrolet Impala.  Roll call vote:  Bohling, aye; Hutton, aye; Wittmann, aye.
Assessor Smith presented tax list correction #1109-19, Black Hills Nebraska Gas, Centrally assessed Public Utility Personal Property, tax credit $3,664.58, “Department of Revenue reached a settlement agreement for the 2010 total taxable value after Black Hills Nebraska Gas Protested.  Motion by Hutton, seconded by Bohling to approve tax list correction for Black Hills Nebraska Gas in the amount of $3.664.58.  Roll call vote: Hutton, aye; Wittmann, aye; Bohing, aye.
Motion by Hutton, seconded by Bohling to defer refund payment for 5 years, declaring hardship for refunding the $2,652.24 to Black Hills Nebraska Gas.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
With no further business to come before the Board of Equalization motion by Hutton, seconded by Bohing to adjourn the Board of Equalization meeting at 11:22 a.m.  Roll call vote:  Hutton, aye; Bohling, aye; Wittmann, aye.

COMMISSIONERS MEETING
SEPTEMBER 28, 2001
County Board of Commissioners of the County of Nemaha, State of Nebraska met on September 28, 2011, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on September 22, 2011. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.

Motion by Wittmann, seconded by Bohling to adopt Resolution 2011-37 to approve a 5 year agreement with the City of Auburn for Cooperative Use of Equipment Under the Inter Local Cooperation Act.  Roll call vote:  Hutton, aye; Bohling, aye; Wittmann, aye.
Motion by Bohling, seconded by Wittmann to approve a 4 year Contract and Appointment for Nemaha County Public Defender with Fankhauser, Nelson, Werts & Ziskey in the amount of $51,200.00 for 2 years (2011 & 2012) and $52,400.00 for 2 years (2013 & 2014).  Roll call vote:  Wittmann, aye; Bohling, aye; Hutton, aye.
The following fuel bids for October, 2011 were received:  Lueders Petroleum No. 2 Diesel $3.415, Unleaded $3.165; Farmers Coop No. 2 Diesel $3.34, Unleaded $3.075.  Motion by Wittmann, seconded by Bohling to award the fuel bid for the month of October, 2011 to Farmers Coop.  Roll call vote: Bohling, aye; Hutton, aye; Wittmann, aye.

Nemaha County Treasurer Pat Holtzman presented the Annual Distress Warrant Report for delinquent personal property taxes and mobile homes as I.O.L.L. for the year 2009 & prior.   Motion by Wittmann, seconded by Bohling to accept the report of the sheriff’s return and to relieve the County Treasurer of her bond for the total amount submitted to the sheriff.  Roll call vote:  Wittmann, aye; Bohling, aye; Hutton, aye.
Motion by Bohling, seconded by Wittmann to strike the following delinquent taxes:  Kevin & Peggy Werts 2008-005828 $30.00, 2007-005790 $34.51; Allmed Staffing 2006-000017 $26.43; Sandra Wolf 2004-000220 $92.67; Heartland Health Resources 2004-000225 $85.08; Premier Health Staffing 2004-000297 $45.06; Superior Medical Services 2004-000346 $29.44.  Roll call vote: Bohling, aye; Hutton, aye; Wittmann, aye.
