In accordance with Section 72-205.01 of the Nebraska Statutes, NOTICE is hereby given that the Board of Educational Lands and Funds has adopted a new rental schedule according to classification and a new schedule of valuations for all school and any other lands managed by the  Board in Nemaha County; and that such new schedules, together with a tabulation of the valuation and the amount of semiannual rental of each  lease, has been filed in the office of the county treasurer of such county and shall become effective January 1, 2012.

The undersigned natural person of the age of twenty-one years or more, acting as the incorporator of a corporation under the Nebraska Non-Profit Corporation Act, adopts the following Articles of Incorporation for such corporation:
ARTICLE I
The name of the corporation shall be “Licensed Medical Nuclear Occupational Professionals, Inc., (hereafter referred to as “the Corporation”).
ARTICLE II
The period of duration is perpetual.
ARTICLE III
This organization is a nonprofit public benefit corporation and is not organized for the private gain of any person. It is organized under the Nonprofit Public Benefit Corporation Law for charitable, scientific and educational purposes.
The specific purpose for which the Corporation as organized includes, but is not limited to, establishing national standards of excellence and certification of medical practitioners and other professionals who perform medical exams for the nuclear energy industry in an effort to ensure the highest level of public safety.
ARTICLE IV
The Corporation may have one or more classes of members, the qualifications and rights, including voting rights, of which shall be designated by a majority of the Board of Directors.
ARTICLE V
The registered agent is Dr. Michael L. Zaruba, who is a resident of the state of Nebraska and a director of the Corporation, and the address of its initial registered office is 2115 14th St., Suite #100, Auburn, Nebraska 68305, which is physically located in the county of Nemaha.

City Council Proceedings
August 22, 2011
The Mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on August 22, 2011, at 7:00 o’clock P.M., in Regular Meeting, open to the general public.
The meeting was called to order by Mayor Scott Kudrna.  Upon roll call, the following members of the City Council were present:  Billings, Bishop, Clark, Critser, and Erickson. Absent:  Holtzman.

Council approved the claims which have not been previously approved by motion or resolution and ratified the ordinary and necessary expenses allowed and in accordance with Resolution No. 7-11 that was approved February 28, 2011.
Mayor Kudrna presented preliminary information on the upcoming budget and asked for input and questions.

Jonathan Neeman was appointed to the position of police officer and the City Clerk administered the oath of office.  
The City Council confirmed the following appointments/reappointments:  Matt Hug, Troy Wynn, Bryan Kinnaman, Megan Clark, John Gill, Brett Matteen, Shawn Phillips, Chad Stickell, Bill Chapin, Angelo Ligouri, Bill Dickerson to the City Recreation Committee; Kris Baker and Angelo Ligouri to the Ordinance Committee; and Dylan Donnelly to the Auburn Volunteer Fire Department.  
The City Council confirmed the appointment of Chris Erickson, Mitch Bishop and Scott Kudrna to the Health Insurance Renewal Committee.
Public Hearing was held concerning adoption of program guidelines as proposed by the Revitalization Review Committee, for renovations to improve structural integrity, historic restoration of building exteriors, and City Code compliance assistance for commercial buildings in the project target area through the Auburn Downtown Revitalization Community Development Block Grant (11-DTR-105).  After allowing public comment, the City Council adopted the program guidelines as proposed by the Revitalization Review Committee, for commercial buildings in the project target area through the Auburn Downtown Revitalization Community Development Block Grant (11-DTR-105).
A motion was approved to request proposals for solid waste collection.  
With four Council Members (Erickson, Billings, Bishop and Critser) voting in favor and one Council Member (Clark) voting against, a special election on a ½ cent city sales tax increase was approved and authorized by the passage and adoption of Resolution No. 20-11.
Ordinance No. 28-11, Amending Section 98.027 of the existing City Code on Animal Impounding, was approved.
An Impounding Agreement between the City of Auburn and Town & Country Veterinary Clinic, Auburn, Nebraska, was approved.    

The proposed ordinance relating to Black Hills Energy’s Franchise Fee to the City of Auburn was discussed but was not introduced.  
The proposed ordinance relating to the Board of Public Works’ Franchise Fee to the City of Auburn was not introduced.
Reports were given by the following department heads:  library, fire department, street department, police department and City Treasurer.  Written financial reports were given on the sales tax receipts, investments, and operating expenditures in July 2011 compared to July 2010.
The following committee provided a report:  Economic Development.  A written financial report was provided by the Auburn Community Redevelopment Authority.
There being no further business to come before the Mayor and Council, the City Council adjourned.

City Council Proceedings
September 12, 2011
The Mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on September 12, 2011, at 7:00 o’clock P.M., in Special Meeting, open to the general public.
The meeting was called to order by Mayor Scott Kudrna.  Upon roll call, the following members of the City Council were present:  Billings, Bishop, Clark, Critser, Erickson and Holtzman.  Absent:  No one.
Mayor Kudrna announced “I am required by law to inform the public that a copy of the Open Meetings Act is posted on the North wall of these Chambers by the entrance door”.  
Public Hearing was held on the proposed FY 2011-2012 Budget.  The Mayor gave an updated presentation on projected revenues and expenditures.  There was no opposition voiced during the public hearing.  The public hearing was closed.  With five Council Members (Bishop, Critser, Erickson, Holtzman, and Billings) voting in favor and one Council Member (Clark) voting against, Council approved the 2011-2012 Budget and authorization was given for the publication of any changes to the Notice of Budget Hearing and Budget Summary previously published.  Approval was given to increase the base of restricted funds by 2.5% and any additional amount for allowable growth. The Council approved a motion to exceed the budget limit on restricted funds by an additional one percent and that the total unused restricted funds authority was set in accordance with the approved allowable increases.  Proposed Ordinance No. 31-11, Annual Appropriation Bill, was approved.
Approval was given for attendance at the League of Nebraska Municipalities 2011 Annual Conference to be held Sept. 28-30 in Lincoln.  
With three Council Members (Critser, Erickson, and Clark) voting in favor of a motion to approve the property and casualty insurance proposal submitted by the Casey Agency and Berkshire Hathaway Homestate Insurance Companies, three Council Members (Holtzman, Billings and Bishop) voting against, the Mayor broke the tie vote by voting in favor of the motion.   Motion:  Passed and said proposal was approved.
With three Council Members (Erickson, Bishop, and Clark) voting in favor of the passage and adoption of Resolution No. to exempt the payment and exclude the collection of city implemented franchise fees from industries with at least 100 full-time employees, three Council Members (Holtzman, Billings, and Critser) voting against, the Mayor broke the tie vote by voting in favor of passage and adoption of the resolution.
The City approved financial backing in support of the Auburn Memorial Library Foundation in obtaining an interim financing loan from the Auburn State Bank for funding assistance for an addition to the Auburn Memorial Library by the passage and adoption of Resolution No. 22-11.
The City Council passed and approved Ordinance No. 32-11, to correct a manifest error within Section I and Section III of Ordinance No. 15-08 associated with the zoning in Block 10 of Grandview Addition, Auburn, Nemaha County, Nebraska.
Discussion was held regarding Brian Steele’s proposal to build a structure to process animals and operate a retail specialty meat store and the related request by Auburn Development Council Inc. that the City forgive the repayment of the loan from the Auburn CDBG-ED Revolving Loan Fund which financed the purchase of four lots in Block 29 Sheridan Addition so that Mr. Steele could be given the lots.  
Upon recommendation by Southeast Nebraska Development District,  the City Council approved an amendment to the existing CDBG Housing Rehab contract with applicant 09-AUB-014 to increase the contract amount by $3,416.  
The City Council confirmed the appointment of Randy Bennett as the City’s fire protection representative to the MFO and the appointment of Clinton Stonebarger as a part time police officer by a five (Erickson, Holtzman, Billings, Bishop, and Critser) to one (Clark) vote.
The City Council approved Resolution No. 23-11 authorizing and prescribing the manner by which Lots 106 and 107 in Crestview Addition may be sold.
A motion was approved by the City Council to go into closed session to discuss strategy with respect to Betty England vs. City of Auburn with legal counsel.  The Mayor restated the limitation of the subject matter of the closed session.  The City Council entered the closed session at 8:50 p.m. and reconvened in open session at 9:15 p.m. No action was taken.
There being no further business to come before the Mayor and Council, the City Council adjourned.
