Such deed of trust was given to secure the payment of a certain promissory note in writing dated July 27, 2006.
The plaintiff alleges in its Complaint that there is now due the plaintiff on said note the principal sum of $36,703.25, together with interest thereon. The plaintiff is the present owner and holder of such deed of trust and the indebtedness secured thereby.
The plaintiff prays that in default of payment by the defendants of the amount due the plaintiff as aforesaid, such mortgaged premises be decreed to be sold according to law to satisfy the sums found due the plaintiff, with interest and costs of suit, and that such defendants be forever barred and foreclosed of all right, title, lien, equity of redemption or other interst in, to and upon such mortgaged premises.

City Council Proceedings

The Mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on April 25, 2011, at 7:00 o’clock P.M., in Regular Meeting, open to the general public.
The meeting was called to order by Mayor Scott Kudrna. Upon roll call, the following members of the City Council were present: Billings, Clark, Critser, and Holtzman. Absent: Erickson.
Mayor Kudrna announced “I am required by law to inform the public that a copy of the Open Meetings Act is posted on the North wall of these Chambers by the entrance door”.
Mayor Kudrna appointed Mitch Bishop to the position of Council Member 3rd Ward to fill the vacancy on the City Council created by Dennis Wittmann’s resignation. The oath of office was administered and Mitch Bishop took his place at the City Council table.

Council approved the claims presented and ratified the ordinary and necessary expenses allowed and in accordance with Resolution No. 7-11 that was approved February 28, 2011.
With four Council Members (Bishop, Clark, Critser, and Holtzman) voting in favor and one Council Member (Billings) voting in opposition, firemen were given approval to attend fire school, two staff members of the library were given approval to attend the Southeast Library System Training Extravaganza on May 19th and approval was given for city office representation at the Data Technologies Computer Software User Group Meeting on May 5th.
The letter from Richard Schneider resigning his position as a Board Member of the Board of Public Works was accepted.
Mayor Kudrna appointed Richard L. Wilson to the position of Board Member of the Board of Public Works and Linda Maine to the Auburn Volunteer Fire Department.
Brian Reetz with The Groundwater Foundation addressed the council on the ground water foundation and possible development of a green site in Auburn.
The request presented by Preston Bruss to allow the painting of the leaf on Courthouse Avenue as part of the Empowerment Camp activities and community service was approved with the street to be closed from approximately 6:30 p.m. to 8:00 p.m. on that day (scheduled for June 28th) and the cost of paint to be allowed.
The agreement with the Auburn Chamber of Commerce to relocate the Chamber of Commerce office into the Auburn city hall was approved.
Maintenance Agreement No. 51 with the Nebraska Department of Roads was approved.
Ordinance No. 11-11, to amend the original section 51.028 of the City of Auburn Code of Ordinances regarding delinquent water accounts, was approved.
Ordinance No. 12-11, to amend the original section 53.30 of the City of Auburn Code of Ordinances regarding delinquent sewer accounts, was approved.
CDBG #09-HO-6047 Drawdown #13 and the related claims were approved.
The City Council approved a motion to allow the closing of the city streets for the Fire Department’s 100th year anniversary parade, the closing of the highway contingent upon coordination with the Nebraska Department of Roads, and the use of other city property as requested.
Reports were given by the following department heads: street department, library, fire department, police department and City Treasurer. Written financial reports were given on the sales tax receipts, investments, operating expenditures in March 2011 compared to March 2010, and a report of services provided by the Board of Public Works.
The following committees provided reports: Street, Keep Auburn Beautiful, Budget/Finance, Economic Development, Safety Committee, Building Committee, and Legislative. A written financial report was provided by the Auburn Community Redevelopment Authority.
There being no further business to come before the Mayor and Council, the City Council adjourned.

Motion by Bohling, seconded by Wittmann the City of Auburn Law Enforcement will provide enforcement of the city ordinance violation and Nemaha County will provide legal services for prosecution. Tiny Tot’s Day Care owner Lynsey Handley and Deb Reiman visited with the board regarding encroaching on Nemaha County’s property at 1908 O Street, Health & Human Service Building. She is requesting an easement to encroach on Nemaha County’s property because she is required to build a fire escape to her second level of her building. Handley will prepare an easement for the board to review.
Laura Osborne, Director for Nemaha Against Drug and Alcohol Abuse visited with the board and provided background information on the NADAA program
Marty Fattig, Director Nemaha County Hospital presented a price quote in the amount of $362,284.00 for a Hologic Digital Mammography System from Brown’s Medical and the additional service agreements for 2 additional years in the amount of $97,642.00 for a total of $469,926.00 with the cost of the mammography system and service agreement being paid for with a Leona M. & Harry B. Helmsley Charitable Trust grant. Motion by Bohling, seconded by Wittmann to ratify the purchase of the Hologic Digital Mammography System from Brown’s Medical and additional 2 year service agreement in the total amount of $469,926.00 as recommended by the Nemaha County Hospital Board with the cost of the system and service agreement being paid for by a grant. Roll call vote: Wittmann, aye; Bohling, aye; Hutton, aye.
