PUBLIC NOTICE
RESOLUTION NO. 12-7-09
WHEREAS, the Village Board of Trustees wish to place this issue before the voters of the Village of Brownville, Nebraska, for their decision at the Primary Election on May11, 2010; and,
WHEREAS, the Legislature of the State of Nebraska in Sections 77-27, 142, R.R.S. 1943 (as amended), authorizes the local governmental units to impose a sales and use tax of one percent within the incorporated municipality on which the State of Nebraska is authorized to impose a tax pursuant ot the Nebraska Revenue Act of 1967, as amended; and,
WHEREAS, the citizens of the Village of Brownville, Nebraska, have expressed their desire to maintain and improve public infrastructure within the community, including capital improvements and equipment, through the implementation of a one percent (1%) sale tax; and,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF TRUSTEES OF THE VILLAGE OF BROWNVILLE, NEBRASKA, as follows:
Section 1. The Village Board of Trustees hereby find and determine that the two questions set forth in Section 2 of this Resolution should be submitted to the qualified electors of the Village of Brownville at the primary election to be held on May 11, 2010.
Section 2. At the primary election to be held on May 11, 2010, there shall be submitted to the qualified electors of the Village of Brownville the following propositions:
Proposition No. 1:
“Shall the Village Board of Trustees of the Village of Brownville, Nebraska, impose a Sales and Use Tax in the amount of one percent (1%) upon the same transactions with the Village of Brownville on which the State of Nebraska is authorized to impose a tax? And shall the proceeds collected therefrom be used specifically for funding capital improvements and equipment ?”
(If a majority of the votes cast upon such question shall be in favor of such tax, then the Board of Trustees of the Village of Brownville, shall be empowered as provided by Section 77-27, 142, R.R.S. Neb. 2003, and shall forthwith proceed to impose a tax pursuant to the Local Option Revenue Act. If a majority of those voting on the question shall be opposed to such tax, then the Board of Trustees of the Billage of Brownville shall not impose such a tax).
Vote FOR or AGAINST the forgoing proposal:
[ ] For said one percent (1%) Sales and Use Tax.
[ ] AGAINST said one percent (1%) Sales and Use Tax.
Proposition No. 2:
“If Proposition No. 1 on the question of the imposition of a Sales and Use Tax in the amount of one percent (1%) is approved, Shall said added one percent sunset in ten (10) years?”
Vote FOR or AGAINST a ten (10) year sunset:
[ ] FOR a Ten (10) year sunset on said added tax.
[ ] AGAINST a Ten (10) year sunset on said added tax.
The ballots to be voted upon and cast at said election shall have printed thereon the foregoing Proposition No.1 followed by the words: “For said one percent (%) Sales and Use Tax” and “Against said one percent (1%) Sales and Use Tax” following said proposition No.1.
The ballots to be voted upon and cast at said election shall have printed thereon the forgoing Proposition No. 2 followed by the words “For a Ten (10) year sunset on said added tax” and Against a Ten (10) year on said added tax” following said proposition No. 2.
Section 3. Notice of said election shall be given to the qualified electors of said Village by publication at least one time each week for three consecutive weeks prior to such election and a copy of the sample ballot shall be published one time not more than ten days nor less than three days prior to the election, such notice and sample ballot to be published in the Nemaha County Herald, a newspaper published and of general circulation in said Village, and the Clerk of the Village Board be and hereby is directed to cause such notice and sample ballot to be published.
Section 4. The Village Clerk of the Village of Brownville shall be and hereby is authorized and directed to certify a copy of this Resolution to the County Clerk/Election Commissioner of Nemaha County, who shall designate the polling places, appoint the election officials and otherwise conduct the election as provided by law. As required by Section 32-802, Reissue Revised Statutes of Nebraska, as amended, the County Clerk shall provide for publication of the Notice of Election in a newspaper designated by the County Clerk no later than forty days prior to the day of said election and such notice shall be posted in the office of the County Clerk no later than forty days prior to such date of election.
Section 5. The form of ballot and form of notice of said election shall be substantially in the form submitted to this meeting, a copy of which forms shall be made a part of the minutes. The Village Clerk is hereby authorized and directed, in conjunction with the County Clerk/Election Commissioner to arrange for the printing of the necessary ballots for said election and to do all other things and take all other action appropriate or necessary in order to cause said proposition to be submitted to the qualified electors of the Village of Brownville as above provided.

You are hereby notified that the City of Auburn is taking bids for the complete demolition and site clearance of 4 properties in Auburn Nebraska located at: Project #2=2002 “J” Street, Project #3=2006 “J” Street, Project #4=2002 10th Street, Project #6=2417 “S” Street.
Bids must be received by the City Clerk’s office, City of Auburn, 1101 “J” Street, Auburn, NE 68305 on or before 7:50 AM on Monday 5-17-2010. At which time bids will be publicly opened and tabulated for presentation to the Auburn Housing Advisory Board/KAB and City of Auburn City Council. NOTE: The 4 properties in this Bid Round #2 have had an inspection for asbestos containing materials and were found to contain asbestos containing materials which the City has had removed via an asbestos abatement contractor. As such, by the time the Demolition Contractor is hired via this bid letting process, these 4 properties are to be clear of asbestos containing material per the follow up asbestos inspection. Following the City of Auburn Building Inspector and City Fire Chief coordinating the management of burning of some of these 4 structures in place, this contracted demolition project is to include demolition and clearance of the remains of the houses including any basement foundation walls and/or basement floors according to the adopted Auburn building codes, and any detached structures, trees/stumps, cellar, and other miscellaneous debris. Please See Specification XV for specific item(s) to be retained/maintained/ to remain on site once the demolition project has been completed.
This activity is being funded via the HUD Neighborhood Stabilization Program and as such has specific standards and documentation requirements.

The County of Nemaha, Nebraska will receive sealed bids for the general repair & tuck pointing of the exterior the Nemaha County Courthouse until 10:00 a.m., Wednesday, May 12, 2010.
Sealed bids must be sent or submitted to the office of the Nemaha County Clerk, 1824 N St. Courthouse Ste 201, Auburn NE 68305. All sealed bids must be marked on the outside of the envelope “Sealed Bid, Repair of Courthouse Exterior”.
All bids received will be publicly opened in the order in which they are received. No bidder may withdraw their bid for a period of 30 days after the time of receiving the bid.
Within ten (10) days following the award of the Contract, the successful bidder shall furnish a surety bond or bonds in an amount equal to or greater than the full amount of the contract. The surety and form of the bonds are subject to the acceptance by the Board of Commissioners of the County of Nemaha, Nebraska.
The Board of Commissioners of the County of Nemaha, Nebraska reserves the right to reject any and all bids or to waive any irregularities in bids received.
Award of the Contract will be in accordance with the County Purchasing Act’s competitive bidding considerations as set forth in Neb. Rev. Stat. §23-3110 to 23-3114, and the Board of Commissioners of Nemaha County, Nebraska will, at its discretion, award the contract on the basis of the lowest responsible bid received.

The Board of Education of School District #29 of Nemaha County met on April 19, 2010 at the Auburn City Hall for the purpose of conducting the regular board meeting. Notice of the meeting was duly published in the Auburn Newspapers.
President Beth Kernes Krause called the meeting to order at 7:00 p.m. Roll call of members present were: Hemmingsen, Zaruba, Kennedy, Billesbach, Oestmann and Kernes Krause.
Motion by Zaruba and second by Kernes Krause to approve the consent agenda that includes the minutes of the 3-15-10 regular meeting. Roll call vote: Zaruba (yes), Kennedy (yes), Billesbach (yes), Oestmann (yes), Kernes Krause (yes) and Hemmingsen (yes). Motion carried 6-0.

Motion by Billesbach and second by Kennedy that the board approve the change to the Auburn High School Handbook regarding mid-term graduation, as presented.
Motion by Zaruba and second by Oestmann to table the motion to approve the change to the Auburn High School Handbook regarding mid-term graduation. Roll call vote: Billesbach (no), Oestmann (no), Kernes Krause (no), Hemmingsen (no), Zaruba (no), and Kennedy (no). Motion failed 0-6.
Billesbach withdrew the motion and Kennedy made the second to withdraw the motion that the board approve the change to the Auburn High School Handbook regarding mid-term graduation.

Hayes gave the clerk $50.00 for rent of the town hall that he used this past weekend.
Hayes told board members that President Obama has declared Nemaha County as one of the counties in Nebraska that is eligible for Disaster Relief from the Winter Snow Storms in December 2009. Also President Obama has declared Nemaha County as one of the counties in Nebraska that is eligible for funding for the recent Flooding of the Missouri River in March 2010.
Sailors wanted to thank Hayes and other town members for their help to get the park ready for the Easter Egg Hunt. Sailors wanted to know about the light that was up at the Park and why it wasn’t there any more. Hayes said that it kept getting shot out, so Hayes told Board of Public Works to remove it. Sailors said they need a new 50 gallon trash barrel at the park. Hansen said there’s an extra one that he can put at Capital Square. Also some of the picnic tables boards needs repaired at the park. Motion by Sailors, seconded by Hansen to have Sailors purchase the supplies for the picnic tables repairs. Roll Call: All yes votes. Motion carried.
Opera House Renovation: Sailors would like to have the construction on the Opera House stop on the Flea Market Times, Ole Time Autumn, 4th July Celebration.
Terry Jones owner of TJ’s Tavern was present to ask the town board if they would give him permission to have an Outside Concert Saturday July 17, 2010. Motion by Wheeldon, seconded by Hansen to approve the outside concert for Terry for the date July 17, 2010. Roll Call: All yes votes. Motion carried.
Project Building, Opera House: Doty read a letter that he had received from Marvin Thomas stating that he is no longer a license architect but was giving his opinion as a past resident of Brownville where he lived and graduated from the old brick school. He would like to see the curve roof stay and no false front. We need to honor the past not the future for the Opera House renovation. Use Brownville Brick and to keep the windows small. Acoustics on the ceiling would help some.
Chairman Hayes received a letter from John Lauber stating that on behalf of the residents of Brownville he requested the opportunity to see drawings showing how the town hall will be remodeled. John also stated in his letter that since we all will be paying taxes to provide the matching dollars, we should be able to see what we are getting. John also said in the letter that we should have drawings of both the exterior and the interior of the Opera House, and would be nice to have the drawings in color. Wheeldon said that the drawings does not have to be in color. Doty said the plans has been at the meetings for people to look at. Wheeldon said a copy of the plans will be posted on the window of the Wheel Museum for residents to view. Hayes said the drawings of both the exterior and interior can not be done till the contractors are chosen by the town board. Lauber continues in his letter that Hayes in his position as Chairman of the board he (Hayes) has a responsibility to keep us, the public informed as to how our taxes are being spent.
A special meeting will be held April 26, 2010 at 6:30 p.m. at the Opera House (town hall). At that time sealed bids for the renovation of the Opera House will be opened by Chairman Hayes. No other items will be discussed at this meeting. The Public is invited to the Special Meeting. The Special Meeting Notice will be published in the Auburn Newspaper Public Notices for two times, April 15, 2010 and April 22, 2010.
Motion by Hansen, seconded by Sailors to approve Gary Oldfield to remove the playground equipment at Capital Square Park and the metal etc. from the shell of the old fireman’s funnel cake trailer, and to haul them off. Roll Call. All yes votes. Motion. Carried. Clerk is to send a letter from the Village Board to Gary Oldfield giving the approval for Oldfield to remove and to have of the scrap metal for himself.
Hayes asked the board if they would like to give $100.00 towards the expense of the Easter Egg hunt that was held at Capital Square Park April 3rd. Motion by Wheeldon, seconded by Hansen to approve the $100.00 to help towards the expense for the Easter Egg Hunt. Roll Call: All yes votes. Motion Carried.
Sealed bids for the Village’s mowing for the summer 2010 were opened by Wheeldon. Three sealed bids were received for the mowing of the four places. The bids were: Reiger Lawn $180.00, Natisha Winkleman $150.00, Dennis Whittmann $100.00. Motion by Hansen, seconded by Wheeldon to approve the bid from Dennis Whittmann at $100.00. Roll Call. All yes Votes. Motion. Carried.
Sailors is going to see Pavers (Doug Sterling) to get a bid for the street work. Motion by Wheeldon, seconded by Doty to adjourn. Roll Call. All yes votes. Motion Carried. Meeting adjourn 7:50 p.m.
