Minutes of the Village of Brownville Town Board Meeting

July 9, 2012

Meeting called to order at 6:30pm by Chairman Martin Hayes.  Board members present Paul Fish, Martin Hansen and Jay Tallmon.  Bob Sailors came at 7:00pm.  Also present Kay Fish, clerk.

Motion by Hansen, seconded by Tallmon to accept the agenda as written.  All yes votes.  Motion carried.

Motion by Fish, seconded by Tallmon  to approve the minutes of the June 11 meeting as written.  All yes votes.  Motion carried.

Projects, Buildings and Equipment:

Hayes was asked by a village resident if the blacktop on Second Street could be extended to the brush dump driveway.  Fish wanted to know where the Village property line is.  Tallmon stated that the village does not want to pave that part of the street if it is county property.  If it is county property they may be willing to put asphalt chips on this portion of the street.

Fish was asked to contact contractors for bids on the street work in the Village for 2012.

Hansen said he will be responsible for the clearing of trees and brush around the Village when the weather cools.

The County has looked at the bridge on Third Street and will be repairing it with pilings.

The County will be calling the One Call Service about areas they were unable to grade earlier and will return to finish the grading of the side of the streets.

Tallmon will contact the NRD about the rock dust by the grain elevator.

Old Business:

Hansen noticed that during some performances of the Theater, Water St. is completely blocked.  This must remain open for fire and rescue vehicles.  A letter will be written to the Theater to inform them of this situation.

Hansen has authorized a new curb stop be installed at the Erma Myers residence.

New Business:

Fish moved that the Village retain Peggy Kuser as the Village CPA.  Tallmon seconded.  All yes votes.  Motion carried.

The members studied the building permit request of John Solie.  Tallmon moved and Fish seconded that the building permit be approved.  All yes votes.  Motion carried.

Fish discussed the possibility of reopening the campgrounds south of Riverside Park.  He wanted to know about sewer and electric possibilities.  Hayes stated that you can’t go deep enough for a sewer but a pole and transformer could be put in for electricity.  Concrete pads are already in place, but need to be unearthed.  Hansen would want to know what the Village’s liability would be.  Hayes suggested that the interested entities contact our engineering firm, JEO, for further assistance.

The Village is considering capping two wells.  Fish questioned why we had to cap the wells. He was told that it is mandated by the state.  The Nemaha Natural Resources District has a cost share assistance on approved well abandonment costs of $500.00 per well.

Tallmon moved that we apply for two cost share assistance grants for helping with the expense of capping our wells.  Fish seconded.  All yes votes.  Motion carried.

A FEMA survey was discussed and Hayes and Hansen will fill it out for the Village.

Sailors wants an announcement made before each board meeting that the Open Meetings Act is posted on the east wall of the meeting room as is required by law.  This will be done beginning with the August meeting.

National History Day competitors addressed the Board with a review of the presentations made in College Park, Maryland.  Students Kelsey Bohling, Alissa Gerdes, Micah Spruth-Janssen, and Samantha Teten, along with parents Amalia Spruth-Janssen, Tim and Melody Teten described the overall experience and expressed gratitude for the support from the Board to enable the students to benefit from such an opportunity.  Micah Spruth-Janssen placed sixth nationally for his presentation, which was the highest placing of any Nebraska competitor.

Julia Oestmann reported on the civics leadership program in which she, Jaceey McCoy, and instructor Lori Broady participated, including five days in Omaha at UNO, followed by a trip to Washington, D.C. where they were able to witness much of what was learned in Omaha.  The program was funded in full by the sponsoring organization from UNO and the Nebraska Department of Education.

The Principal’s written report  included a summary of the Data Retreat held June 6 and 7 attended by Mrs. Kelsay, along with instructors Sandy Behrends, Jan Gerdes, Megan Howe, Nicole Lade, Irene Seeba, Mary Stewart, Tera Stutheit, Jane Wenzl, and Karen Wolken.  Mrs. Kelsay also reported that the D.A.R.E. program would be held in 2012-2013 through the Nemaha County Sheriff’s Department, funded by the Region V Systems.

The Superintendent’s report included an update of the negotiations process, with details to be discussed later in closed session.  The resolution for an interlocal agreement with Sterling Public Schools for Spanish classes is on the agenda, as well as the final reading of Policy 5008 Attendance Policy and Excessive Absenteeism.  A vehicle mileage report for 2011-2012 was included in the agenda materials.  Mr. Koehler reported he would meet with bus drivers on July 18 to establish bus routes for the new school year.  He reviewed the availability of handicap accessible vehicles.  Mr. Koehler reported that several trees had been trimmed by Harold Richardson and that the recommendation was made to take down the large maple tree on the southwest corner of the premises.  Mr. Koehler stated that decision could be made later.

Jim Gerking presented an update of the football field turf project.  To date, costs are within $300 of projected costs.  Additional gravel will be spread before the carpet is installed.  Mr. Gerking estimated that the donated work to date amounts to approximately $95,000.  He noted that the grant funds will be received in May or June, 2013.

Moved by Keith Bohling to approve the second and final reading of Board Policy 5008, Attendance Policy and Excessive Absenteeism.  Seconded by David Bohling.  Roll call vote:  All ayes.  Motion carried.

Moved by Arlen Grotrian to approve renewal of membership in the Nebraska Rural Community Schools Association for 2012-2013 at a cost of $700.  Seconded by Lonnie Neddenriep.  Roll call vote:  All ayes.  Motion carried.

Moved by Duane Caspers to approve the resolution to enter into a Consortium through an Interlocal Cooperation Act Agreement for a Spanish Teacher with Sterling Public Schools.  Seconded by Keith Bohling.  Mr. Koehler noted that since both Sterling and Johnson-Brock belong to Network Nebraska, $1000 will be received each semester by each school to help defray the costs.  Roll call vote:  All ayes.  Motion carried.

Moved by David Bohling to enter into executive session at 8:42 p.m. to protect the public interest and prevent needless injury to the reputation of an individual.  Seconded by Keith Bohling.  Roll call vote: All ayes.  Motion carried.

County Board of Commissioners of the County of Nemaha, State of Nebraska met on July 11, 2012, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on July 5, 2012. You will take Notice that the Plaintiff did on the 29the day of May, 2012, file his Complaint against you in the above entitled court, praying for the foreclosure of real estate tax sale certificates on the following described real estate, to wit: The South Half of the Northwest Quarter of Section 1, Township 4 North, Range 13 East, Nemaha County, Nebraska, and in Lot 1 and 2 and the East 330 feet of the fractional Northwest Quarter of the Northwest Quarter and the fractional North Half of the North East Quarter, all in Section 1, Township 4 North, Range 13 East, Nemaha County, Nerbaska;

The object and prayer of which is the foreclsure of real estate tax sale certificates issued by the Nemaha County Treasurer on said property; praying that Plaintiff be adjudged a valid, prior, paramount and first lien upon each tract of the real estate in the amount of taxes, special assessments and other charges assessed and levied against the real estate that Plaintiff paid, plus interest from and after the date of payment at the rate of 14% per annum; and whatever interest in, right to or title to or lien upon the real estate herein Defendants or any of them may have is inferior, junior and subject to the lien held by the Plaintiff. Plaintiff also prays that an accounting be had of the amount due Plaintiff by virtue of his lien on each tract for unpaid taxes, interests, costs and for attorney’s fees as provided for by law; that Plaintiff be adjudged to be entitled to foreclose his lien on each tract of the real estate at public sale to satisfy the decree so entered. In default of payment of such sums found to be due and owing to the Plaintiff for 20 days from the entry of decree herein, each tract of the real estate herein shall be sold for the satifaction of the lien; and further prays that the Defendants and each of them be foreclosed and forever barred of all claims upon, interest in, right or title to, lien upon or equity of redemption in the real estate; and upon the sale of the real estate and upon the payments by the purchaser of all subsequent taxes which shall have accrued, the purchaser there shall take a good an indefeasible title to the real estate and shall be placed in possession thereof; that judgment be entered in Plaintiff’s favor and against each tract of the real estate in the principal amount of the taxes paid as alleged herein, plus interest computed at 14% per annum from and after the date each item of said taxes was paid, plus title reports costs, court costs, lis pendens filing costs and attorney’s fees permitted by law in the amount of 10% of the total amount due to Plaintiff; and for such other and further relief as the Court deems just and equitable.

You are required to accept or plead to said Complaint on or before the 21st day of August, 2012, or the allegations of said complaint will be taken as true and judgment rendered accordingly.

PUBLICATION LEGAL NOTICE

IN THE MATTER OF THE PATERNITY OF H.H. to T.H. and John Doe, described as a white male.

You have been identified as the biological father or possible biological father of a caucasian female child whom the biological mother currently intends to place for adoption or for whom the Nebraska Department of Health and Human Services is currently conducting adoption planning. The placement occurred on or about May 25, 2010.

H.H. was conceived on or about December 22, 2007 in Omaha, NE and was born on September 22, 2008 in Omaha, NE.

If you are the biological father, you have the right to: 1) deny paternity; 2) waive any parental rights you may have; 3) relinquish and consent to adoption; 4) file a Notice of Objection to Adoption and Intent to Obtain Custody pursuant to Nebraska Revised Statute section 43-104.02 or; 5) object to the adoption in a proceeding before any Nebraska court which has adjudicated you to be the biological father of the child prior to your receipt of notice.

In order to deny paternity, waive your parental rights, relinquish and consent to the adoption or receive additional information to determine whether you are the father of H.H., you must contact the undersigned agency. If you wish to object to the adoption and seek custody of the child you must seek legal counsel from you own attorney immediately.
