NOTICE OF PUBLIC HEARING ON APPLICATION FOR
COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
• Park Avenue Street Project – 12-PW-CDBG Project    
• NOTICE IS HEREBY GIVEN that on June 11, 2012 as part of the regular Peru City Council meeting that starts at 7:00 P.M. at the Peru City Hall, 614 5th Street, the Peru City Council will hold a public hearing concerning an application to the Department of Economic Development for a Community Development Block Grant for a Public Works category request.  This grant is available to local governments for community development activities.
• The City of Peru is considering requesting $350,000 in CDBG funds for the Park Avenue Street Project.  CDBG funds are being requested for the following CDBG activity codes:  up to $333,000 in CDBG funds for code #0070 - Public Facilities & Improvements and up to $17,000 in CDBG funds for code #0181- General Administration for a total CDBG request of $350,000.  These CDBG funds will be combined with local match of $333,000 provided by the City of Peru and the Peru State College Foundation.  The project will benefit all the citizens of Peru, in which 52.7% or 301 individuals are currently low to moderate income persons.  No persons will be displaced as a result of these CDBG activities.  
The 12-PW CDBG Project is being developed to address issues with Park Avenue in Peru.  Proposed activities include widening & replacing the roadway, adding a concrete curb and gutter on both sides of the street, and adding a 10 ft. wide sidewalk/trail on the west side of the street for the ½ mile stretch from the city limits to 5th Street.

NOTICE
Assessed values have been established for tax year 2012 on real property in Nemaha County, and the assessment roll is complete.  On May 31, 2012, notices of increased or decreased valuation changes were mailed to owners of record in Nemaha County as of May 20, 2012.
Any property owner who questions the valuation of his or her real property, or who believes that his or her property is assessed at a different level of value than similar property in the county, may file a valuation protest with the County Board of Equalization.  Valuation protests must be filed with the Nemaha County Clerk’s Office on or before June 30, 2012.

Public Notice
The County of Nemaha, Nebraska will receive sealed bids until 9:15 a.m., June 13, 2012 for a ‘Hydraulic Detachable Gooseneck Trailer’. Minimum bid specifications and bid form can be picked up at the Nemaha County Clerk’s Office during normal business hours.
Sealed bids must be sent to Joyce Oakley, Nemaha County Clerk, 1824 N Street, Auburn NE 68305. All bids must be clearly marked on the outside of the envelope:  “Sealed Bid Trailer”.  
All bids must be accompanied by a “Bid Bond” or “Certified or Cashier’s Check” in the amount of 5% of the total bid made payable to the Nemaha County Treasurer as evidence of good faith that the successful bidder will enter into a contract with the County of Nemaha, Nebraska to deliver the item bid as per the specifications.
Bids received will be simultaneously opened publicly and in the presence of the bidders or representatives of the bidders.
Awarding of the bid will be in accordance with Section No. 10 of LB 393 known as the County Purchasing Act.

MAY 23, 2012
Board of Equalization of the County of Nemaha, State of Nebraska met on May 23, 2012 Commissioners Chambers, Nemaha County Courthouse, Auburn NE. Notice of meeting published in the Nemaha County Herald on May 17, 2012.  The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website ( HYPERLINK “http://www.nemahacounty.ne.gov” www.nemahacounty.ne.gov).  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Equalization.  The Board of Equalization has the right to modify the agenda to include items of an emergency nature only at such public meeting.

Rev. Statute 24-337.01 and Neb. Rev. Statute 24-507 (3) (4), ‘authorizes the County District Court Clerk and State to enter into an agreement for the provision of County Court services by District Court Clerk’ and ‘ District Court Clerk, State and County after consultation with a District Court Judge serving Nemaha County, County Court Judge serving Nemaha County and the County Attorney for Nemaha County to enter into an agreement for the provision of District Court Services by County Court personnel’.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
Scott Kudrna, Mayor City of Auburn visited with the Board regarding the 2013, 2014, 2015 Dispatching Contract with the City of Auburn.  Changes to the contract will be $50,000.00 for FY 2013, FY 2014 and $51,000.00 for FY 2015.  
Larry Ossowski, Blue Rivers Area Agency on Aging presented the July 1, 2011 through June 30, 2012 annual activities report.  They also presented the FY 2012-2013 budget request $7,543.00 (same as last year) and a request of approximately $11,000.00 (+/-) for the purchase of Small Bus (seating 12 ambulatory plus 2 wheelchair positions).
Motion by Wittmann, seconded by Bohling to enter executive session at 10:00 a.m. employee resignation. MINUTES OF THE MEETING OF THE BOARD OF PUBLIC WORKS
OF THE CITY OF AUBURN, NEMAHA COUNTY, NEBRASKA
HELD MAY 14, 2012
THE BOARD OF PUBLIC WORKS OF THE CITY OF AUBURN, NEMAHA COUNTY, NEBRASKA (BPW), met in regular session on the 14TH of May, 2012 at the regular meeting place of the Board at the hour of 12:00 p.m.  This meeting was held in open session as required by Chapter 84, Article 14 of Nebraska Statutes.
Chairman Hahn called the meeting to order and requested roll call:  Members present –Glenn, Gulizia, Hahn, Kubik, & Wilson.
Chairman Hahn announced this was an open meeting and information about open meetings was posted on the north wall of the Board Room.
Chairman Hahn noted all Board Members have received a copy of the Agenda for this meeting.
Chairman Hahn recognized guest Dottie Holliday and asked if she had anything for the Board.  She stated that she did not have anything at that time.  Chairman Hahn recognized guest Bryan Mellage who thanked the Board for allowing him to work on Unit # 12.  He stated he appreciated the opportunity.
General Manager Dave Hunter introduced John Trecek from Ameritas.  Mr. Trecek showed the Board some options regarding refinancing the Wastewater Treatment Plant and the Water Treatment Plant.  Member Gulizia made a motion to have Mr. Trecek bring back both 18 year and 20 year amortizations with all costs for review of the Board next month.  Member Wilson seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
Mike Schwab with Beehive Mapping Systems’ showed the Board the software package that Beehive developed to create utility system maps and track repairs and other issues within the utility system.  A proposal was presented to the Board for their consideration.  This item will be discussed again at the June Board Meeting.
Carla Mason with American Dream Real Estate explained to the Board what she meant by “Traveling Sewer Fee”.  That is when a resident moves from one home to another, their sewer usage fee goes with them.  After much discussion, it was decided that this was the only logical way to establish sewer fees.  Ms. Mason was to work with Accounting & Finance Manager (AFM) Melissa Sierks to see if any adjustments were needed on the tenants in question due to water leaks at the previous residence.
Ms. Mason also addressed the Board regarding having commercial customers pay a three month rolling average on their sewer fees.  Ms. Mason felt that if there was a water leak, the commercial customers had to pay for it three times rather than once.  Member Gulizia made a motion to change sewer billing from three month average to previous month’s actual water usage on commercial customers.  Member Wilson seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
Member Gulizia asked the Board to consider removing capacity fees on water and sewer from vacant properties in the City of Auburn.  After discussion, the Board asked GM Hunter to prepare a list of properties being charged capacity fees in Auburn for review at the June Board Meeting.
The Honorable Mayor Scott Kudrna addressed the Board regarding charges paid by the City of Auburn to the Board of Public Works.  Mayor Kudrna stated that other cities such as Broken Bow, Gothenburg, and Minden paid a reduced charge for electricity and that they did not pay any water or sewer.  Mayor Kudrna stated that eliminating water and sewer charges would save the City of Auburn approximately $20,000 per year.  Member Gulizia made a motion to eliminate water and sewer charges to the City of Auburn accounts.  Member Wilson seconded the motion.  Roll call:  those voting aye – Gulizia, Hahn, Kubik, & Wilson: those voting nay - Glenn.  Chairman Hahn declared the motion carried.  GM Hunter was assigned the task of reviewing electric rates charged to other cities and to report on those rates at the June Board Meeting.
Member Gulizia suggested that the Board consider shifting administrative costs and salaries to the electrical department from the water and wastewater departments.  Discussion was held regarding whether or not the state statutes provide for such shifting of costs and salaries.  It was decided that this item would be tabled until the June Board Meeting to allow for further research.
Member Wilson asked for clarification on the agreements with Peru, Nemaha, and Brownville regarding providing services to them for water and wastewater.  GM Hunter explained the calculation of the BPW hourly rate that is charged, it includes an average of everyone’s wages and overhead.  Member Wilson also asked to insure that the BPW is not liable if something happens while working in these other locations.  GM Hunter stated that we were covered under the mutual aid agreement that is incorporated into the documents with each of the communities.  Member Wilson requested a legal opinion spelling out that we are not liable when working in the other communities.  GM Hunter will do the research and provide further information at the next Board Meeting.
Member Gulizia presented to the Board a change to the proposed personnel manual regarding benefits.  Member Gulizia stated that this item was for discussion only at this time so as to give everyone time to fully review the policy change.  The reaction of the employees to the proposed change was discussed.  It was decided that Member Gulizia and Member Wilson would meet with employees as part of a wage committee.  GM Hunter stated that he would ask for volunteers to serve on the wage committee at the employee staff meeting the following Wednesday.

GM Hunter explained to the Board the process of extending water and sewer mains.  GM Hunter recommended to the Board that they hire JEO to draw up construction standards for water and sewer main extensions at a cost of $1,500 rather than submitting individual plans to HHS each time an extension of water or wastewater was needed at a cost of 1% of the total construction cost.  Member Glenn made a motion to approve having JEO establish construction standards for water and wastewater.  Member Kubik seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter updated the Board on issues surrounding the Water Treatment Plant and the Buy American Issue.  The only item of contention still open was regarding the dehumidifier.  GM Hunter explained that he will have a meeting with HHS on the issues later on in the week.  
GM Hunter explained to the Board that the Reservoir had a potential issue due to the warping of the wooden boards along the top of it.  GM Hunter was concerned because the gaps could allow birds to nest inside the top of the reservoir.  GM Hunter recommended hiring a contractor for $3,500 to go in and seal the top of the reservoir so that the possible entry of birds would be eliminated.  Member Kubik made a motion to hire a contractor to spray foam around the top of the reservoir at a cost of $3,500.  Member Wilson seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter presented a Fire Prevention Program that the safety committee was recommending that the Board approve for inclusion in the BPW loss prevention manual.  Member Wilson made a motion recommending including the Fire Prevention Program in the BPW loss prevention manual.  Member Glenn seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter presented a contract for the Board’s approval from the Western Area Power Administration (WAPA).  GM Hunter explained that nothing had changed in the contract from previous contracts.  Member Glenn made a motion to approve the WAPA contract.  Member Kubik seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter recommended to the Board to hire Layne Western to pull Well # 6 and rehab it.  He also suggested meeting with the property owners near our proposed future well sites to determine whether the individuals would be interested in selling property to the BPW.  Member Kubik made a motion to approve hiring Layne Western to rehab Well # 6 at a cost of $10,000 plus parts and to have GM Hunter meet with property owners.  Member Glenn seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
A newsletter for May 2012 was submitted to the Board for their approval.  Member Wilson made a motion to approve the newsletter.  Member Gulizia seconded the motion.  Roll call:  those voting aye – Glenn, Gulizia, Hahn, Kubik, & Wilson.  Chairman Hahn declared the motion carried.
On Financial:  
AFM Sierks presented the Board with all the normal reports regarding financial, and asked for any questions regarding the financial reports.  AFM Sierks mentioned that at the time of the reports, the pledging with ASB was short but has since been corrected.  
Chairman Hahn asked for any objections or exceptions to the General Consent Items listed under Agenda Item #22.  Motion was moved by Member Glenn, seconded by Member Wilson, the Board approve the General Consent Items listed below:
a)    Approve the previous meeting’s minutes and dispense with reading of same,
b)    Approve monthly compensation of officers, management and employees as previously fixed by the Board,
