march 28, 2012
County Board of Commissioners of the County of Nemaha, State of Nebraska met on March 28, 2012, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on March 22, 2012. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Hutton called the meeting to order at 8:17 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley.
Chairman Hutton noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.
Visitors present – Mary Kruger, Chairman County Visitors Committee; Dave Swanson, Nemaha County Herald
Motion by Wittmann, seconded by Bohling to approve the agenda as presented.  Roll call vote: Hutton, aye; Bohling, aye; Wittmann, aye.
Motion by Wittmann, seconded by Bohling to approve the March 14, 2012 regular scheduled meeting minutes with no corrections.  Roll call vote: Wittmann, aye; Bohling, aye; Hutton, aye.
Motion by Bohling, seconded by Wittmann to approve the claims for payment as presented by the County Clerk and authorized for payment by the Board of Commissioners.  Roll call vote: Bohling, aye; Wittmann, aye; Hutton, aye.
Marty Fattig, Director for Nemaha County Hospital presented a 10 month statistical and financial report for Nemaha County Hospital.  Fattig reported the purchase of the Data Scope did not need to be ratified because the purchase price was under $10,000.00.
Mark Mainelli discussed several projects with the board on the One & Six Year, stop sign study, roads closure, disposing of bridge replacement right of way, small bridge replacement with tubes.
Russ Newton, NE Machinery presented the board with information on the trail king lowboy trailer NE Machinery sells.
Nemaha County Noxious Weed Board member Joe Moody, Chairman and Phil Walker visited with the board updating them on the appointment of a superintendent of Nemaha County Weed Control.  Motion by Bohling, seconded by Wittmann to hire Joe Wittwer upon his accreditation of his license, passing drug & alcohol test, and back ground checks.  Wittwer will receive $13.00 per hour for wages.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.
Board visited the jail for a quarterly jail inspection.
Motion by Wittmann, seconded by Bohling to adopt Resolution 2012-10 authorizing Mark Mainelli with Mainelli Wagner & Associates to conduct a study for the possibility of closing or vacating county road #117 beginning at the NW corner of the SW ¼ Section 9 T6N R13E south to the north bank of the Little Nemaha River.  Roll call vote: Hutton, aye; Bohling, aye; Wittmann, aye.
Motion by Wittmann, seconded by Bohling to adopt Resolution 2012-11 authorizing Mark Mainelli with Mainelli Wagner & Associates to conduct a study for the possibility of closing or vacating county road #49 beginning at the South quarter corner of Section 5 T6N R13E, or beginning 2,640 feet west of the SE corner of Section 5 T6N R13E, west to the bank of the Little Nemaha river.  Roll call vote:  Bohling, aye; Hutton, aye; Wittmann, aye.
Motion by Wittmann, seconded by Bohling to accept the resignation of Sandra Bertelsen from the Nemaha County Visitor’s committee, effective immediately.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
Motion by Wittmann, seconded by Bohling to appoint Sondra Westenberg to the Nemaha County Visitor’s Committee to March 2014, for the unexpired term of Sandra Bertelsen.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.
The following fuel bids for April, 2012 were received:  Lueders Petroleum No. 2 Diesel $3.845, Unleaded $3.815; Farmers Coop No. 2 Diesel $3.84, Unleaded $3.69.  Motion by Bohling, seconded by Wittmann to award the fuel bid for the month April 2012 to Farmers Coop.  Roll call vote: Wittmann, aye; Bohling, aye; Hutton, aye.
Motion by Bohling, seconded by Wittmann to adopt Resolution 2012-12 approving the subdivision of a 2.84 acre tract of land in Section 1 T5N R14E for Andy & Amy Behrends.  Roll call Vote:  Bohling, aye; Wittmann, aye; Hutton, aye.
Motion by Bohling, seconded by Wittmann to purchase a 2012 Chevrolet pickup with the state purchasing price through Meyer Earp Auto Center.  Roll call vote:  Wittmann, aye; Hutton, aye; Bohling, aye.
