PUBLIC HEARING NOTICE
Blue Rivers Area Agency on Aging is seeking a capital acquisitions grant through the Nebraska Deparment of Roads to purchase two (2) small buses. The funds will be provided by Federal and Local resources. The estimated cost of each ADA accessible vehicle is $55,000.
These vehicles will replace older models that are currently being used within the Blue Rivers Agency Transportation program in Nemaha and Otoe Counties. This acquisition will allow for transportation services to continue for individuals within this service area.

County Board of Commissioners of the County of Nemaha, State of Nebraska met on March 14, 2012, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting. Notice of meeting published in the Nemaha County Herald on March 8, 2012. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website. C. J Johnson Region V Systems, Dave Merrill Region V Services, and Bob Kinghorn Region V Services presented their annual reports and FY 2012-2013 budget requests.
Jim Biaggi visited with the BOC on the telephone regarding the travel time he will have for attending RC certification classes in Lincoln the week of March 19th through March 23rd. The Principal’s written report included information regarding state speech competition and FBLA Spring Leadership Conference, noting that a motion for overnight approval was on the agenda. Mrs. Kelsay reported that all teacher evaluations had been completed. She reported that NeSA on-line testing will be conducted between April 17 and May 3, noting that the state’s testing window was from March 26 to May 4. Mrs. Richardson is currently registering students for classes for the 2012-2013 school term. Mrs. Kelsay reported to the Board that next month’s agenda would include whether to continue with cheerleading as a school activity.
In the Superintendent’s report, Mr. Koehler provided a list of 22 eligible kindergarten students for next year. He discussed results of a student survey conducted among students in grades 7 through 11 regarding school activities. Mr. Koehler noted the need for an updated Internet Policy as a requirement of the state to be in place by July 1. He reported that no additional bids were received for the roof of the concessions building and explained the purpose of a Request for Qualification process for the purpose of studying proposed changes to the 1957 building’s front windows, front entrance, classroom air exchange/conditioning/heating. He noted that there was no cost for the initial process and that a percentage of any projects actually undertaken would be paid.
Mr. Koehler reported that Laverne Michel made some minor repairs to the shop roof and advised that time be given to see if that was effective in stopping the leaks. Discussion was held regarding the proposal to install artificial turf on the football field.
Moved by Duane Caspers to approve the overnight stay for state speech competition in Kearney on March 22 and for the FBLA State Leadership Conference in Omaha on March 29 and 30, 2012. Seconded by Lonnie Neddenriep. Roll call vote: All ayes. Motion carried.
Moved by Keith Bohling to approve the first reading of the Internet Safety and Acceptable Use Policy No. 6800. Seconded by David Bohling. Roll call vote: All ayes. Motion carried.
Moved by David Bohling to regretfully accept the resignation of Karen Johns at the end of the current school term. Seconded by Duane Caspers. Roll call vote: All ayes. Motion carried.
Moved by Lonnie Neddenriep to approve the bid from Caspers Construction of Beatrice for the concessions building roof project. Seconded by Darren Oestmann. Roll call vote: David Bohling, aye; Keith Bohling, aye; Caspers, abstain; Neddenriep, aye; Oestmann, aye. Motion carried.
Moved by Keith Bohling to intend to enter into a Performance Contract with a qualified provider who will adhere to the Request for Qualification (RFQ) process as identified in LB 1129 for selecting a Performing Contracting company to potentially implement a variety of facility improvement measures. Mayor Ryan officially opened the public hearing for the 2012 1&6 Year Street Plan and informed the public of the location of the posting of the Nebraska Open Meetings Act.

Present were: Mayor Lesley Ryan and Council Members: Joe Whisler, Judie Douglas, Kan Hastings and Jay Moran. Upon roll call by the City Clerk, a quorum was declared. Also present: PSC President Dr. Dan Hanson and Kristie Wemhoff.
Mayor Ryan called the meeting to order and informed the public of the location of the posting of the Nebraska Open Meetings Act.
The Council reviewed the minutes from the January 9, 2012 Council Meeting. Council Member Whisler made motion to accept the minutes as written. Council Member Moran seconded the motion for acceptance. Vote indicated: “AYE” All. Motion: Carried.
The Clerk reported the November 2011 sales tax deposit was $2,822.77. Correspondence was received from City Attorney Steven Mercure regarding the property at 600 5th Street and the property in Block 179 of the City of Peru. The County Clerk submitted a request to use City Hall for the Primary Election on Tuesday, May 15 and the General Election on Tuesday, November 6.

Mayor Ryan stated the water report is available at City Hall for public inspection and noted that the report is again very detailed and is greatly appreciated.
Mayor Ryan presented her Mayor’s report for January. The City Clerk will be attending Clerk School from March 12th thru 16th and received a $150.00 scholarship based on a narrative she wrote. Legislative Bulletins are available at the city office if council members would like a copy. The city maintenance workers plowed snow, picked up trash, maintained the white-goods and compost sites, performed vehicle maintenance, read meters, performed water turn-offs/ons and identified and repaired vandalized signs.
Regarding Agenda Item #1, Park Avenue Project Discussion, Dr. Dan Hanson with Peru State College was present to discuss some possible options to make improvements to the area. Lengthy discussion followed.
Regarding Agenda Item #2, State Relinquishment of Park Avenue, Council Member Hastings felt the City could use $345,000 and that we are already maintaining the street and is in favor of having this money for future needs. Lengthy discussion followed with no action taken.
Council Member Hastings made motion to grant permission to SENDD to proceed with application submission for the Park Avenue Project. Motion was seconded by Council Member Moran. Vote indicated: “AYE” All. Motion: Carried.
Regarding Agenda Item 4, Housing Rehab Program Housing Board Appointment, Mayor Ryan asked if the Council would like to be the housing board, or do they want to appoint people to serve on the board. Council Member Whisler stated we should give the citizens of Peru an option to serve. The Clerk said since we have plenty of time she will post the need for committee members and will put a 1 month deadline on it. If we do not get enough people for a committee, the Council can act as Housing Board.
Agenda Item 5, Council Member Hastings stated he spoke with Mr. Turner several times and told him he should attend a meeting to express his desire to place a trailer on his 916 7th Street property. Council Member Hastings made motion to accept the City Attorney’s recommendation to not allow the placement of a trailer at 916 7th Street. Motion was seconded by Council Member Whisler. Vote indicated: “AYE” All. Motion: Carried.
Regarding Agenda Item 6, the Lease Agreement Approval with JagWire Enterprises, states there would be an increase of $50.00 per month on what we receive from JagWire based on the fact we no longer use their internet service. Council Member Moran asked how much of a presence they have at the tower. The Clerk stated she has never had any problems with them and has not even seen them in town. Council Member Hastings asked if the $50.00 per month covers the new internet service. The Clerk was not certain and said she would look up the amount of the current internet service and would adjust the lease agreement accordingly and present at the next council meeting.
Regarding Agenda Item 7, Council Member Hastings approached the Council with the desire to change the on-sale alcohol operating hours in the City of Peru to 2:00 a.m. on Fridays and Saturdays because he is losing revenue during that last hour. After lengthy discussion, Council Member Moran made motion to adopt ordinance #2012-01 to amend section 10-117 of the Peru municipal code; alcoholic beverages; hours of sale. For the purpose of amending the hours of sale concerning alcoholic liquors: To repeal all ordinances and resolutions or part thereof in conflict herewith; and to provide the effective date hereof. Motion died due to the lack of a second motion.
