The Nebraska Board of Pardons will hold a public meeting in the Governor’s Hearing Room, Second Floor, State Capitol, Lincoln, Nebraska on Thursday, March 22, 2012, at 1:00 p.m. to hear applications for clemency.  The following case from Nemaha County will be heard:
FOR FULL PARDON:
Miranda L. Falk for full pardon of felony convictions wherein she was convicted in Nemaha County and sentenced on August 9, 2000 to a term of seven days at the county jail for the offense of Possession of a Controlled Substance: Marijuana Weighing more than One Ounce but not more than One Pound; to a term of 18 to 24 months at the Nebraska Department of Correctional Services for the offense of Possession of a Controlled Substance: Methamphetamine, with Intent to Deliver Near a School; and to a term of one year at the Nebraska Department of Correctional Services for the offense of Possession of a Controlled Substance: Cocaine.

Tony Ambrose for full pardon of felony conviction wherein he was convicted in Nemaha County and sentenced on November 26, 1986 to a term of two years probation for the offense of Possession of Marijuana More than One Pound.

Pursuant to NDEQ’s Title 118 - Ground Water Quality Standards and Use Classification, public notification and opportunity for comment is hereby given of the following:
1. On or about November 15, 1999, a petroleum release was identified originiating at 9th & G Streets, Auburn. An approximate legal location is NE1/4, SW1/4, Section 15, Township 05N, Range 14E, Nemaha County.
2. Follow-up investigation identified the effects of the release and led to the remedial actions proposed by NDEQ. The investigation resulted in a determination that this ground water contamination event is defined as remedial action class two.
3. The source of the release has been removed. A Risk-Based Corrective Action (RBCA) Tier 1 assessment was conducted. The assessment indicated the presence of dissolved petroleum compounds in ground water. The containment concentrations found were below the numerical levels used by the RBCA process to establish a need for further investigation or remediation. The NDEQ has determined that no further remedial action is necessary due to the lack of threat to human health or safety.

Any person may receive further information or submit comments ont he proposed actionm, and request or petition NDEQ for a hearing, in writing, stating the nature of the issues to be raised int he hearing, on or before April 2, 2012. february 22, 2012
County Board of Commissioners of the County of Nemaha, State of Nebraska met on February 22, 2012, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on February 16, 2012. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Hutton called the meeting to order at 8:15 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley.

Laura Osborne, Director NADAA presented NADAA quarterly report.
Larry Holtzman visited with the board regarding the price for replacing the windows at the Multi-Plex Bldg.  Holtzman could not provide the board any costs for the windows.
Holtzman requested the board prepare bid specs for public bidding of the windows.
Chairman Hutton opened the public hearing on February 22, 2012 at 10:30 a.m. to approve the One & Six Year Plan for Highway Improvement for Nemaha County, Nebraska 2012-2018.  Notice of hearing was published in the Nemaha County Herald on February 2, 2012, February 9, 2012 and February 16, 2012 and also posted on the public bulletin boards at Carson National Bank, Auburn State Bank, and Nemaha County Courthouse on February 1, 2012.
Visitors present at the hearing:  no one.
Mark Mainelli, Nemaha County Highway Consultant prepared Nemaha County’s One & Six Year Plan for Highway Improvement 2012-2018 and mailed it to the Board of Commissioners for review prior to the public hearing.

Public Notice of renewal of Auburn Country Club liquor License was published on January 12, 2012 in the Nemaha County Herald with February 10, 2012 as the deadline to receive written protests to the issuance of automatic renewal of said license. Village of Brownville Town Board Meeting
February 13, 2012
Meeting called to order at 6:30pm by Vice Chairman Martin Hansen.  Board members present:  Bob Sailors, Paul Fish, Jay Tallmon and clerk Kay Fish.  Martin Hayes came at 7:40pm.
Motion by Tallmon, seconded by Fish to approve the agenda as presented.  All yes votes.  Motion carried.
Motion by Fish, seconded by Sailors to approve the minutes of the January 9, 2012 meeting as written.  All yes votes.  Motion carried.
Financial report was reviewed.  Motion was made by Tallmon, seconded by Fish that the financial report be accepted as printed.  All yes votes.  Motion carried.
The claims were reviewed.  The addition of Paul Davis Restoration of Omaha was made.

Projects, Buildings and Equipment:
Hearing for the One and Six Year Road and Street Plan:  Sailors wants the addition of the Third Street Bridge on the plan.  The southwest corner is caving in .  Tallmon will talk to the NRD about their help with this situation.
Sailors made the motion that the One and Six Year Road and Street plan be accepted with the addition of the Third Street bridge work.  Tallmon seconded.  All yes votes.  Motion carried.
Repair of fence on west side of Opera House.  Martin Hayes was absent so there was no report.
Sound system for Opera House.  Tallmon wanted to be clear what the Board wanted in a system.  The Board would like to see speakers, an amplifier and a microphone that can be used both inside for staged productions and outside for parades, etc.  Tallmon will continue to look for a suitable system.
Old Business:
Sailors made a motion to rescind the bid from Abernathy Construction for the work on the garage door to the lower level of the Town Hall and that the bid process begin again.  Tallmon seconded.  All yes votes.  Motion carried.
Sailors had questions about the Riverside Park.  He wanted to know if the money that Randel Smith gave back to the Village was earmarked specifically for the park.  The answer was yes it was for the park.   He wanted to make sure that no Village money was used on the Riverside Park for repairs from the flood.  Tallmon stated that the work not covered by FEMA funds could be in-kind or volunteer work.
New Business:
Dave Hunter from the Auburn Board of Public Works was present.  He presented the franchise check from BOPW to the Board.  He gave updates on the work being done by BOPW.  He reported that the BOPW is now operating the wastewater and water facilities in Peru and Nemaha.  His team of five operators is available to help with our wastewater facility if needed.  The fee is $35.00 an hour and traveling expenses. Fish asked about electrical lines being placed underground.  Hunter said all new service will be underground and they continue to work on the old lines.
Liquor license renewals.  Sailors moved and Tallmon seconded that the liquor license for the Brownville Concert Hall be renewed.  All yes votes.  Motion carried.
Fish moved and Tallmon seconded that the liquor license for Whiskey Run Creek Winery be renewed.  All yes votes.  Motion carried.
Membership in Merchants of Brownville.  The dues are $84.00 per year.  Fish moved that the Village of Brownville become a member of MOB for 2012.  Sailors seconded.  Sailors yes, Fish yes, Hansen yes and Tallmon abstain.  Motion carried.
Membership in Nemaha County Development Alliance.  Will not join at this time.
Preserve America Project - Nora Tallmon.  Nora said that all entities that need to sign off on the project have done so and the Gateway signage is ready to go.  She stated that a Brownville citizen contacted the Omaha office of Preserve America and wanted some of the project funds.  The only people authorized to contact the Preserve America Project officials are:  Marty Hayes, Kay Fish and Nora Tallmon.
Reimbursement to Tom Rudloff for clerk’s office.  The Village has paid $30.00 per month to Rudloff.  Tallmon moved that the amount be increased to $45.00 per month.  Sailors seconded.  All yes votes.  Motion carried.
Sailors reported that there is a hole on North 4th Street that had previously been filled that is caving in again.
He also wanted to know about Highway 136 from the top of the hill to the bridge.  He was told that the highway is slated to be repaired in 2012.
Tallmon reported that a rigging company that will be making a delivery to Cooper Nuclear is going to work on the road base in Riverside Park and give some monetary reimbursement for use of the park.
Corky Jones was present to clarify his role in the work to be done in Riverside Park, Wharf Street and around the wastewater facility.  The board members and Jones were to meet at the clerk’s office at 9:30 am, Tuesday, Feb. 14, to review the Project Worksheets from FEMA.  Sailors questioned whether Wharf Street needs to be re-rocked.
