MINUTES OF THE MEETING OF THE BOARD OF PUBLIC WORKS OF THE CITY OF AUBURN, NEMAHA COUNTY, NEBRASKA
HELD DECEMBER 12, 2011
THE BOARD OF PUBLIC WORKS OF THE CITY OF AUBURN, NEMAHA COUNTY, NEBRASKA (BPW), met in regular session on the 12th of December, 2011 at the regular meeting place of the Board at the hour of 12:00 p.m.  This meeting was held in open session as required by Chapter 84, Article 14 of Nebraska Statutes.
Chairman Hahn called the meeting to order and requested roll call:  Members present –Glenn, Hahn, Kubik, Snyder, & Wilson.
Chairman Hahn announced this was an open meeting and information about open meetings was posted on the north wall of the Board Room.
Chairman Hahn noted all Board Members have received a copy of the Agenda for this meeting.
General Manager (GM) Dave Hunter gave a presentation called Utility Rates 101 to the Board.  This presentation discussed methods of determining utility rates.  Guest Randy Hellsbusch with the Nebraska Rural Water Association was also present to answer questions for the Board.  GM Hunter stated that the methodology presented would be used to prepare the 2012 rates for Water and Sewer to be presented at the next Board Meeting.
GM Hunter presented a new Transportation Agreement to the Board from Black Hills Energy.  This agreement would not require an upfront payment of $18,000 from the BPW.  GM Hunter asked the Boards approval of the Transportation Agreement.  Member Snyder made a motion to approve the Black Hills Energy Transportation Contract.  Member Glenn seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
Accounting & Finance Manager (AFM) Melissa Sierks presented to the Board recommended changes to the Personnel Policy of the Board of Public Works.  These changes updated the terminology for winter hours vs summer hours, clarified funeral leave, made changes to Section 125 spending, and changes to flu shots.  Member Kubik made a motion to approve the recommended changes to the personnel policy.  Member Snyder seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
AFM Sierks presented to the Board the increases being granted in several communities.  AFM Sierks recommended a 2 % increase to the BPW employees to remain consistent with the increase provided by the City of Auburn to their employees.  Member Kubik made a motion to approve the 2 % increase for BPW employees.  Member Glenn seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
AFM Sierks presented a proposed 2012 Holiday Schedule to the Board for their approval.  The proposal asked the Board to grant an additional 4 hours holiday to the employees for 2012 as Christmas Eve fell on a Monday, and grant the floating holiday as Friday, April 6th.  Member Wilson made a motion to approve the 2012 Holiday Schedule.  Member Kubik seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
AFM Sierks presented to the Board Medical 7 and Medical 23 as proposed Health Insurance Plans for 2012 for BPW Employees.  AFM Sierks also asked the Board to cease offering a Flexible Spending Account through Paychex.  Member Snyder made a motion to discontinue flexible spending accounts and approve Medical 7 & 23 as the Health Insurance Plans.  Member Glenn seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter presented to the Board a proposed Energy Efficiency Rebate Form.  GM Hunter stated that the BPW rebates follow the program offered by NPPD and these were the changes being implemented by NPPD.  Member Snyder made a motion to approve the Energy Efficiency Rebate Form for 2012.  Member Kubik seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter reported that the project Sewer Phase III has been completed and submitted final payment requests from the contractors.  The payment request for TJ Osborn for the lift stations was $4,000.00.  Member Snyder made a motion to approve $4,000 to TJ Osborn.  Member Glenn seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter presented a change order in the amount of $8,001.20 for Midlands Contracting to the Board for approval.  This change order was the result of a section of sewer line needing to be replaced rather than lined.  Member Glenn made a motion to approve the change order.  Member Snyder seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter presented the final payment request from Midlands Contracting in the amount of $138,576.60 for the completion of the sewer line lining portion of the project.  Member Glenn made a motion to approve the final payment to Midlands in the amount of $138,576.60.  Member Snyder seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
GM Hunter reported to the Board that the EPA had conducted an audit on the Buy American part of the funding from the American Recovery & Reinvestment Act.  There were four issues that were identified and two issues that have been resolved.  GM Hunter continues to work with HDR Engineering and the Cadmus Group who performed the audit to resolve the outstanding issues.
Chairman Hahn stated that no response was going to be made regarding the editorial letters submitted to the newspaper from the Mayor.
AFM Sierks presented to the Board a list of quarterly liens for both water and sewer customers that need to be approved and presented to the City Council for filing.  Member Snyder made a motion to approve the liens as presented.  Member Kubik seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
AFM Sierks reported to the Board that the semi – annual payment to NDEQ Fiscal Services is due on December 15th.  At the Board’s request, AFM Sierks reviewed the amounts of the loans and the amounts of the payments with NDEQ.  The loan on the Clearwells had a total balance due of $528,885.52 with a total interest rate of 4.3%.  The Water Department showed unrestricted funds of $531,664.34.  Member Kubik made a motion to pay off the Clearwells Loan using unrestricted funds of the water department for the total amount due of $528,885.52.  Member Snyder seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
On Financial:  AFM Sierks reported that the following CD’s are maturing in December:  23825 FNB.  Member Kubik made a motion to have AFM Sierks use best judgment on reinvestment of the CD.  Member Snyder seconded the motion.  Roll call:  those voting aye – Glenn, Hahn, Kubik, Snyder, & Wilson.  Chairman Hahn declared the motion carried.
Chairman Hahn asked for any objections or exceptions to the General Consent Items listed under Agenda Item #17.  Motion was moved by Member Snyder, seconded by Member Glenn, the Board approve the General Consent Items listed below:
a) Approve the previous meeting’s minutes and dispense with reading of same,
b) Approve monthly compensation of officers, management and employees as previously fixed by the Board,

City Council Proceedings
November 28, 2011
The Mayor and Council of the City of Auburn, Nemaha County, Nebraska, were called to meet at the City Hall at 1101 “J” Street on November 28, 2011, at 7:00 o’clock P.M., in Regular Meeting, open to the general public.
The meeting was called to order by Mayor Scott Kudrna.  Upon roll call, the following members of the City Council were present:  Billings, Bishop, Clark, Critser, Erickson and Holtzman. Absent:  No one.  
Mayor Kudrna announced “I am required by law to inform the public that a copy of the Open Meetings Act is posted on the North wall of these Chambers by the entrance door”.  
Council approved the October 4, 2011, October 24, 2011, and October 25, 2011 meetings’ minutes as written.
The City Council approved the financial report.
A claim from Hunters Headquarters in the amount of $1390.00 was approved.

Council approved the claims which have not been previously approved by motion or resolution and ratified the ordinary and necessary expenses allowed and in accordance with Resolution No. 7-11 that was approved February 28, 2011.
Public Hearing was held to obtain public comment prior to consideration of a declaration of an area of the City as blighted and substandard and in need of redevelopment pursuant to the Nebraska Community Development Law.  With five Council Members (Holtzman, Billings, Bishop, Clark, Erickson) voting in favor and one Council Member (Critser) voting in opposition, a portion of the City and certain areas adjacent to the City and within the extra territorial jurisdiction of the City was declared blighted and substandard by the passage and adoption of Resolution No. 33-11.
The City Council approved the use of Auburn 10-DTR-105 Community Development Block Grant Commercial Rehab funding as suggested by the Revitalization Review Committee by the passage and adoption of Resolution No. 34-11
George Nelson with the Massman Nelson Reinig auditing firm presented the financial audit for the year ending September 30, 2011 and answered questions.
Approval was given to allow employees on the city health insurance program a choice between the health savings plan-Option 23 and PPO Option 7.
Discussion was held regarding the recent sales tax ballot question election results and the impact on the city budget.
The City Council approved the Roth 457 and amended Plan Document for the City of Auburn and Board of Public Works Pension Plan and Trust.
CDBG Grant #10-DTR-105 Drawdown #2 and the related claims were approved.
CDBG #09-HO-6047 “Citywide” Owner-Occupied Housing Rehabilitation Drawdown #20 and the related claims were approved.
Discussion was held regarding Block 29 in Sheridan Addition.
The Agreement Renewal for Maintenance Agreement No. 51 between the Nebraska Department of Roads and the City of Auburn was approved.
The following holidays were approved for 2012:  New Year’s Day (January 2), Memorial Day (May 28), Independence Day (July 4), Labor Day (September 3), Veteran’s Day (November 12), Thanksgiving Day (November 22), Friday after Thanksgiving (November 23), Christmas Eve Afternoon (December 24), Christmas Day (December 25) and a Personal Day (*Choice with Dept Approval).
The Mayor announced that the December City Council Meeting will be held at 7:00 p.m. on December 27th.
Auburn State Bank and First National Bank of Johnson were reappointed as official depositories for city funds.
Reports were given by the following department heads:  library, fire department, street department, police department and City Treasurer.  
The following committees provided reports:  Street, Safety, and Ordinance.   A written financial report was provided by the Auburn Community Redevelopment Authority.

PROCEEDINGS OF THE NEMAHA COUNTY BOARD OF COMMISSIONERS MEETING
DECEMBER 28, 2011
County Board of Commissioners of the County of Nemaha, State of Nebraska met on December 28, 2011, Commissioner’s Chambers, Nemaha County Courthouse, Auburn NE for a regular scheduled meeting.  Notice of meeting published in the Nemaha County Herald on December 22, 2011. The agenda for the meeting was kept continually current and available for public inspection at the office of Nemaha County Clerk during normal business hours and also on the Nemaha County website.  The agenda was held open until one business day prior to the meeting for appearance before the board and items for approval by the Board of Commissioners.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.
Chairman Hutton called the meeting to order at 8:23 a.m. Present for the meeting:  Commissioner District 1 Bob Hutton, Commissioner District 2 Dennis Wittmann, Commissioner District 3 Marvin Bohling and County Clerk Joyce Oakley.
Chairman Hutton noted the posting of the Open Meeting Poster and the availability of the Open Meeting Handouts to the public.

Kermit Moore, Director of Nursing, Nemaha County Hospital presented price quotes for the purchase of Sterile Product Positive Pressure Compounding Isolator.  The following prices quotes were presented by Moore: NuAire NU-PR797-400 $13,035.00 (36 month warranty) GermFree LFGI-3USP $18,061.06 (48 month warranty).  Motion by Bohling, seconded by Wittmann to ratify the purchase of GermFree LFGI-3USP in the amount of $18,061.06 as recommended by the Nemaha County Hospital Board. Brent Lottman, Nemaha County Sheriff visited with the board regarding the disposing of 2 surplus sheriff vehicles.  Motion by Wittmann, seconded by Bohling authorizing Lottman to advertise the sale of the 2 surplus sheriff vehicles through public bidding after the new sheriff’s vehicle is received.  Roll call vote:  Hutton, aye; Wittmann, aye; Bohling, aye.        Fuel Bids for January, 2012 - The following fuel bids for January, 2012 were received:  Lueders Petroleum No. 1 Diesel $3.636 No. 2 Diesel $3.346, Unleaded $3.035; Farmers Coop:  No quote received.
